This book explores the extent of parallelism and cross-influence between Catholic Social Teaching and the work of the world's oldest human rights institution, the International Labour Organisation (ILO). Sometimes there is a mutual attraction between seeming opposites, who in fact share a common goal. This book is about just such an attraction between a secular organisation born of the political desire for peace and justice, and a metaphysical institution much older founded to bring peace and justice on earth. It examines the principles evident in the teachings of the Catholic Church and in the secular philosophy of the ILO; together with the theological basis of the relevant provisions of Catholic Social Teaching and of the socio-political origins and basis of the ILO. The spectrum of labour rights covered in the book extends from the right to press for rights, i.e., collective bargaining, to rights themselves - conditions in work - and on to post-employment rights in the form of social security and pensions. The extent of the parallelism and cross-influence is reviewed from the issue of the Papal Encyclical of Pope Leo XIII De Rerum Novarum (1891) and from the founding of the International Labour Organisation in 1919.

Un coup de projecteur sur un organe indispensable. Le centenaire de l’Organisation internationale du Travail, célébré durant l’année 2019, a rappelé que les normes internationales du travail constituent des outils de premier plan pour le développement des politiques nationales en matière sociale. Le droit international du travail est en outre une source précieuse pour les juges et juristes nationaux dans la résolution des litiges en matière de droit du travail. Les tribunaux s’inspirent ainsi de plus en plus – à des degrés divers selon les pays – des normes internationales du travail et de leur interprétation par les organes de contrôle de l’OIT. Pourtant, cette organisation souffre d’un manque réel de visibilité et reste encore trop souvent méconnue du grand public, voire des praticiens du droit social. Le présent ouvrage est tout entier dédié à l’étude des normes produites par l’OIT, qui constituent l’essentiel de la réglementation internationale du travail. Après un nécessaire détour historique, l’auteur analyse ce qui fait encore aujourd’hui l’originalité de l’OIT dans le paysage des organisations internationales, à savoir : son cadre institutionnel, qui tend à associer sur un pied d’égalité les gouvernements et les partenaires sociaux, sa procédure d’élaboration et d’adoption des normes internationales, réelle révolution pour le droit international, son mécanisme de contrôle du respect par les États parties de leurs engagements internationaux. Il propose ensuite un aperçu des instruments adoptés par l’OIT avant de s’intéresser au rôle actif que devrait jouer le juge national en matière de promotion des normes de l’OIT dans le règlement des différends portés devant lui. L’ouvrage fournit ainsi les clés de compréhension de cette organisation avant-gardiste dans le paysage international et donne un aperçu de son œuvre normative féconde. Il vise aussi et surtout à sensibiliser le lecteur – qu’il soit étudiant, syndicaliste, avocat, magistrat, académique, etc. – à l’importance du rôle joué par l’OIT dans la promotion d’une paix universelle basée sur la justice sociale et à sa contribution au développement d’un programme centré sur l’humain, nécessaire pour un avenir du travail décent.

La loi du 16 mars 1971 est l’une des pierres angulaires de notre droit du travail car elle entend mesurer le temps de travail. Mais les aménagements successifs de cette construction juridique en ont fait un labyrinthe où le risque de s’y perdre est réel. L’ouvrage aborde tous les chapitres de la loi du 16 mars 1971, à l’exception des dispositions du Code pénal social y afférentes. Il se focalise principalement sur le chapitre III intitulé « temps de travail et temps de repos », le plus complexe. Bien que ne relevant pas du champ d’application de la loi du 16 mars 1971, deux thèmes qui sont en lien avec la problématique de la durée du travail sont abordés succinctement : la réglementation relative aux jours fériés et celle portant sur les nouveaux régimes de travail. La mise en œuvre sur le terrain du cadre théorique de la loi conduit parfois à nous écarter des solutions généralement préconisées (comme, par exemple, la manière d’assimiler les périodes de vacances annuelles) mais aussi à proposer un nouveau concept (celui d’« heures bonus »).
