This book focuses on the economic aspects of intellectual property (IP). It includes considerations of the wider category of intangible assets, however, the primary focus is devoted to patents which the author argues are the most vivid example of the Tragedy of Intangible Abundance (TIA). TIA touches upon a key issue in the contemporary economy. On the one hand, there is an enormous supply of intellectual property, yet, on the other, such an abundance does not necessary solve existing issues but rather creates new ones as well. This book elaborates on the reasons for the emergence of TIA and its consequences. The author uses clear metaphors to explain very complex issues. The book provides a valuable and interdisciplinary analysis of the field and offers practical solutions. It is based on the data collected by the author during the qualitative research he conducted among a group of start-ups. It presents guidance on determining which instrument is the most efficient for a particular situation. It also provides arguments for decision-makers and their advisors as to why a more open approach towards intellectual property would be more beneficial under many circumstances in the contemporary economy. While universal issues are addressed, the author distinguishes the European perspective, too. The book is written in a clear and concise style and covers all of the crucial aspects of IP management. It will find an audience among scholars of economics and business.

Intellectual property (IP) law operates with the ontological assumption that immaterial goods such as works, inventions, and designs exist, and that these abstract types can be owned like a piece of land. Alexander Peukert provides a comprehensive critique of this paradigm, showing that the abstract IP object is a speech-based construct, which first crystalised in the eighteenth century. He highlights the theoretical flaws of metaphysical object ontology and introduces John Searle's social ontology as a more plausible approach to the subject matter of IP. On this basis, he proposes an IP theory under which IP rights provide their holders with an exclusive privilege to use reproducible 'Master Artefacts.' Such a legal-realist IP theory, Peukert argues, is both descriptively and prescriptively superior to the prevailing paradigm of the abstract IP object. This work was originally published in German and was translated by Gill Mertens.

This book describes a research project begun by the author in 2015 and co-authored by the chiefs of the KhoiSan peoples living in the Nelson Mandela Bay Municipality, South Africa, aided by staff and students at Nelson Mandela University. The scope of the project was to investigate methods and procedures that could help re-establish the link between the Indigenous communities and their 'forgotten' heritage sites due to the colonial segregations. Making use of a participatory and interdisciplinary method we explored the tangible and intangible heritage of the Eastern Cape province, with particular attention to the remains of precolonial fish traps located along the shoreline. Included also are important testimonies from the KhoiSan chiefs who, alongside the author, led the project.

The book deals in detail with the requirements of existing copyright exceptions, for libraries in German statutory copyright law. In Germany, the same as in all other EU member states, it is the rule that for copyright related "exploitations", such as copying, distribution, presentation or (internet-) communication to the public , there must exist a copyright exception or, if the conditions for such an exception are not met, the consent of the copyright holder must be provided. In 2018, especially for scientists, research and educational institutions, libraries and other cultural heritage institutions , new exceptions were created in Paragraphen 60a ff. of the German Copyright Act (UrhG). At the time of publication of this version of the book, the next copyright reform is on its way, namely the implementation of the "Copyright in the Digital Single Market" Directive ("DSM Directive"). This publication refers to the provisions of the Directive from the respective passages. The DSM Directive must be implemented into German law by June 7, 2021.
