In December 1994 Ukraine gave up the third-largest nuclear arsenal in the world and signed the Non-Proliferation Treaty, having received assurances that its sovereignty would be respected and secured by Russia, the United States, and the United Kingdom. Based on original and heretofore unavailable documents, Yuri Kostenko’s account of the negotiations between Ukraine, Russia, and the US, reveals for the first time the internal debates of the Ukrainian government, as well as the pressure exerted upon it by its international partners. Kostenko presents an insider’s view on the issue of nuclear disarmament and raises the question of whether the complete and immediate dismantlement of the country’s enormous nuclear arsenal was strategically the right decision, especially in view of the 2014 annexation of Crimea by Russia, one of the guarantors of Ukraine’s sovereignty under denuclearization.

"As has been established, there is widespread agreement that customary international law consists of two elements: state practice and opinio juris.114 In relation to the crystallization of opinio juris and practice into binding customary law, one must also bear in mind the ICJ's decision regarding states "whose interests" have been "specially affected" as per the North Sea Continental Shelf case.115 In this case, the Court examined the delimitation of the continental shelf areas in the North Sea in relation to Germany and Denmark as well as between Germany and the Netherlands, looking beyond the partial boundaries which had been previously agreed upon by the parties. L'équipe du Centre de droit international de l'Université Jean Moulin Lyon 3 (CDI) s'est penchée sur des aspects peu connus des enjeux juridiques et politiques liés au nucléaire. Le présent ouvrage restitue un travail de recherche de grande envergure débuté en 2018 questionnant l'impact de la technologie nucléaire tant civile que militaire, sur le droit international. Sans prétendre à l'exhaustivité, les chercheurs du CDI (et leurs invités ! ) ont mis l'accent sur certaines interrogations soulevées, d'une part, par le développement, la menace, l'usage ou encore la réglementation de l'arme nucléaire et, d'autre part, par l'utilisation de la technologie nucléaire à des fins civiles. L'ouvrage revient ainsi sur les enjeux juridiques liés à l'arme nucléaire, notamment en termes de protection de certains espaces fragiles (océans, Arctique - Partie VI), et de tentatives de réglementation. Les Conventions adoptées en la matière font naître une série de questionnements en droit des traités (enregistrement, mise en oeuvre, articulation et même dénonciation - Partie I), mais également en droit international humanitaire (Partie III). Par ailleurs, l'évolution des politiques nationales et des doctrines officielles vis-à-vis de la dissuasion nucléaire démontrent, s'il en était besoin, de la cruelle actualité de la question et du besoin urgent de coopération internationale (Partie II) et régionale - notamment européenne - et d'une réelle politique de non-prolifération (Partie VI). Tout en étant moins teinté d'agressivité, le nucléaire civil n'en reste pas moins une activité dangereuse et susceptible de porter atteinte aux droits humains, tant individuels que collectifs (Partie IV). Si l'hypothèse d'un accident provoquant une catastrophe nucléaire est dans tous les esprits, il n'est pas nécessaire qu'une telle catastrophe se produise pour que les droits humains soient mis en danger. L'implantation même de centrales nucléaires peut parfois entrer en conflit avec les droits des peuples concernés
