In zahlreichen Städten Deutschlands mit Zuzug und besonders in Berlin hat sich der Kampf um die Wohnungspolitik in den letzten Monaten zugespitzt. Dabei sind die denkbaren Handlungsinstrumente vielschichtig – vom jüngst in Berlin eingeführten sogenannten „Mietendeckel" bis hin zu den ebenfalls in Berlin durch ein entsprechendes Volksbegehren geprüften Enteignungen privater Wohnungsbaugesellschaften. Mit diesen beiden Vorschlägen ist eine Verschärfung der politischen Diskussion zu beobachten, die in ihrer Radikalität die Frage aufwirft, ob hier die rechtlichen Rahmenbedingungen nicht nur ohne ökonomischen Sachverstand, sondern auch ohne Beachtung der rechtsstaatlichen Leitplanken modifiziert werden sollen. Ausgehend von einer knappen Skizze der ökonomischen Charakteristika von Wohnungsmärkten, klassifiziert dieser Beitrag die bereits vorhandenen und diskutierten Maßnahmen, um sodann deren verfassungsrechtliche Grenzen aufzuzeigen.

"Evictions in the UK examines the relationships between tenants, landlords, housing providers and government agencies and the tensions and conflicts that characterise these relations. L’insalubrité concerne tout logement ou installation qui représente un danger ou un risque pour la santé ou la sécurité des personnes. In Search of Home explores a new yet less explored space of urban poverty - rehabilitation housing for the displaced poor, which increasingly dots the peripheries of Indian cities. This longitudinal ethnography examines these new liminal zones suspended between a slum and the legal city, producing 'citizenship in-limbo' and relegating the poor to perpetual dependence on the state albeit legal residence. It examines how the flexible governance of such housing produces illegalities, and how state institutions and actors stand to gain through systemic corruption that co-opts urban poor groups, pre-empting radical resistance. This book makes central the gendered nature of such politics, detailing the everyday political work of women, vital to the development of poor neighbourhoods and political struggles for housing. This analysis of rehabilitation housing policies and their implementation, chronicles the myriad strategies employed by the urban poor, from documenting to political performances, in their struggles for a home.
