Russian Federation), Provisional Measures. The documents are reproduced in their original language. The Tribunal delivered its Order on 25 May 2019. It is published in the ITLOS Reports 2018-2019. Le revirement de jurisprudence cristallise une tension classique du droit entre la nouveauté et la sécurité. D’un côté, il permet au juge d’adapter sa jurisprudence à l’évolution de la société. C’est un élément inhérent à la fonction de juger. Mais, de l’autre côté, en prenant le contrepied de la position qui était jusqu’alors la sienne, le juge porte inéluctablement atteinte au principe de sécurité juridique. Le revirement altère la confiance des justiciables et risque de remettre en cause l’autorité des décisions voire in fine de compromettre leur exécution. How do the judges of the International Court of Justice, the most authoritative court in international law, use teachings when deciding cases? This book is the first book-length examination of how teachings are used in an important international institution. It uses three different methodologies: a traditional legal analysis, an empirical analysis where citations of teachings are counted and interviews with judges and staff. Three main patterns are identified: teachings have generally low weight, but this weight varies between different works and between different judges. The book suggests explanations for the patterns it identifies, in order to contribute to understanding not only when and how teachings are used, but also why, and compares the Court's practice with that of other international courts and tribunals. This study fills a gap in the international legal literature and will be essential reading for scholars and practicing international lawyers.

"The book seeks to determine the manner in which the International Court of Justice interprets and applies the remedies generally accepted by the international community and codified by the International Law Commission in its Articles on State Responsibility. As such, it seeks to answer the following questions: i) Whether the International Court of Justice adopts a specific approach towards the remedies of international law? and ii) If yes, what are the justifications for this approach? The survey of theoretical perspectives, canvassing academic writings and subjective perspectives featured in the pleadings of the parties to the disputes, and the judgments of the Court, illustrates relevant results. The systematic analysis demonstrates that the Court has a distinct approach to the interpretation and application of remedies available in international law. While the Court is cautious in ordering precise actions from the parties, it appears to prioritize declarations regarding issues of legality"--
