"Privacy(recht) is sinds de invoering en inwerkingtreding van de Algemene verordening gegevensbescherming in 2018 meer dan ooit tevoren een hot topic. Op grond van de AVG beschikt de burger over privaatrechtelijke instrumenten om naleving af te dwingen of een schadevergoeding te vorderen bij een inbreuk op de AVG (artikel 82). Op een dergelijke schadevergoedingsvordering is thans het nationale (schadevergoedings)recht van toepassing. De Hoge Raad heeft in het EBI-arrest (15 maart 2019) in algemene zin uitgewerkt wanneer sprake is van een persoonsaantasting op andere wijze in de zin van artikel 6:106 sub b van het Burgerlijk Wetboek. Een persoonsaantasting kán worden verondersteld wanneer de nadelige gevolgen gelet op ‘de aard en de ernst van de normschending' zo voor de hand liggend zijn. Bij een schending van het recht op bescherming van persoonsgegevens gaat het vaak om onbekende en speculatieve nadelige gevolgen. Uit de na het EBI-arrest gewezen rechtspraak blijkt niet altijd even duidelijk wanneer niet-geconcretiseerde immateriële schade bij een inbreuk op het recht op gegevensbescherming nu precies wordt vergoed. Met dit boek beoogt de auteur meer duidelijkheid te scheppen over de (on)mogelijkheden van het verhalen van niet-aantoonbare immateriële schade bij een schending van het recht op bescherming van persoonsgegevens naar huidig Nederlands recht in het licht van de AVG. In het verlengde daarvan introduceert de auteur een gezichtspuntenbenadering aan de hand waarvan de rechter een vordering tot vergoeding van immateriële schade bij een inbreuk op het recht op gegevensbescherming kan beoordelen. Met deze gezichtspuntenbenadering wordt specifiek voor wat betreft het recht op gegevensbescherming invulling gegeven aan het toetsingscriterium ‘de aard en de ernst van de normschending' van het EBI-arrest." --

It offers a new perspective on the cultural history of representing the decolonization of the Dutch East Indies, and maps out how a contested collective memory was shaped. Taking a transdisciplinary approach and applying several theoretical frames from literary studies, sociology, cultural anthropology and film theory, the author reveals how mediated memories contributed to a process of what he calls “unremembering.” He analyses in detail a broad variety of sources, including novels, films, documentaries, radio interviews, memoires and historical studies, to reveal how five decades of representing and remembering decolonization fed into an unremembering by which some key notions were silenced or ignored. The author concludes that historians, or the historical guild, bear much responsibility for the unremembering of decolonization in Dutch collective memory.

Die Nachkriegsgeschichte des sowjetischen Zentralasiens und deren Städte ist bisher nur wenig erforscht. Gerade in jener Zeit veränderten Industrialisierung und Wohnungsbauprogramme nachhaltig die urbanen Räume der Region. Doch die Vorstellung einer radikalen Modernisierung sowjetischer Städte greift zu kurz, denn lokale Prozesse, private Interessen und Handlungsspielräume für unterschiedliche Akteure waren ebenso Teil des städtebaulichen Geschehens.Am Beispiel des privaten Hausbaus in Samarkand der 50er- und 60er-Jahre und mit Hilfe von Zeitzeugenerinnerungen und Archivdokumenten untersucht die Arbeit die legalen wie illegalen Formen dieser Baupraxis, ihre Bedeutung bei der Bewältigung der Wohnungskrise sowie ihre weitreichenden Folgen für die Struktur der Stadt. Sowjetische Stadtplanung erscheint hier als Spannungsfeld von Interessenskonflikten, Aushandlungsprozessen und Kompromissen zwischen Bürokratie, Politik und einzelnen Akteuren.Die Arbeit zeigt die Grenzen des sowjetischen Modernisierungsprojektes und eröffnet damit neue Perspektiven für die historische Stadtforschung der ehemaligen Sowjetunion und speziell für Zentralasien. This study examines private homebuilding as a specific conflict-laden form of urbanization in post-Second World War Soviet Central Asia, based on the example of Samarkand. It elucidates the neglected role of private initiatives in Soviet urban planning and housing policy, which it describes as a tension-filled realm of conflicting interests, urban development tasks, and pressures.
