European legal integration is often justified with reference to the inherent unity of European legal traditions that extend to ancient Rome. This book explores the invention of this tradition, tracing it to a group of legal scholars divided by the onslaught of Nazi terror and totalitarianism in Europe. As exiles in Britain and the US, its formulators worked to build bridges between the Continental and the Atlantic legal traditions, incorporating ideas such as rule of law, liberty and equality to the European heritage. Others joined the Nazi revolution, which promoted its own idea of European unity. At the end of World War Two, natural law and human rights were incorporated into the European project. The resulting narrative of Europe, one that outlined human rights, rule of law and equality, became consequently a unifying factor during the Cold War as the self-definition against the challenge of communism.

Post-war legal scholars commonly consider the Third Reich's judicial system to be the paradigm of 'evil law'. By examining how crucial parts of this distorted normative order evolved and were justified by regime-loyal legal theorists, we can appreciate how law can bend to a political ideology and fail to keep state power from transgressing elementary standards of humanity and the rule of law. From 1933 to 1939, a flood of publications reflected on the question of how to adapt law to the political ends of National Socialism, debating both the normative and constitutional foundations of the National Socialist state, and the proper form and content of criminal and police law in this new political framework. These debates, the main threads of which are central to this book, reveal the normative ideas driving the Führer state and the legal subtext to the Nazi regime's escalating atrocities.

Juriste, il se distingue par la radicalité de ses réflexions sur la progressive disparition de l'Etat au profit de la "communauté" définie par la race et son "espace vital" . Brillant fonctionnaire de la SS - il termine la guerre comme Oberführer (général) -, il nourrit la réflexion nazie sur l'adaptation des institutions au Grand Reich à venir - quelles structures et quelles réformes ? Revenu à la vie civile, il crée bientôt à Bad Harzburg un institut de formation au management qui accueille au fil des décennies l'élite économique et patronale de la République fédérale : quelque 600 000 cadres issus des principales sociétés allemandes, sans compter 100 000 inscrits en formation à distance, y ont appris, grâce à ses séminaires et à ses nombreux manuels à succès, la gestion des hommes. Ou plus exactement l'organisation hiérarchique du travail par définition d'objectifs, le producteur, pour y parvenir, demeurant libre de choisir les moyens à appliquer. Ce qui fut très exactement la politique du Reich pour se réarmer, affamer les populations slaves des territoires de l'Est, exterminer les Juifs. Passé les années 1980, d'autres modèles prendront la relève (le japonais, par exemple, moins hiérarchisé). Mais le nazisme aura été un grand moment managérial et une des matrices du management moderne."
