Abstract

Unrelenting demands for energy, infrastructure and natural resources, and the need for developing states to augment income and signal an 'enterprise-ready' attitude mean that transnational development projects remain a common tool for economic development. Yet little is known about the fragmented legal framework of private financial mechanisms, contractual clauses and discretionary behaviours that shape modern development projects. How do gaps and biases in formal laws cope with the might of concessionaires and financiers and their algorithmic contractual and policy technicalities negotiated in private offices? What impacts do private legal devices have for the visibility and implementation of Indigenous peoples' rights to land? This original perspective on transnational development projects explains how the patterns of poor rights recognition and implementation, power(lessness), vulnerability and, ultimately, conflict routinely seen in development projects will only be fully appreciated by acknowledging and remedying the pivotal role and priority enjoyed by private mechanisms, documentation and expertise.

Abstract

Examining a key puzzle in the study of electoral violence, this study asks how elites organize violence and why ordinary citizens participate. While existing theories of electoral violence emphasize weak institutions, ethnic cleavages, and the strategic use of violence, few specify how the political incentives of elites interact with the interests of ordinary citizens. Providing a new theory of electoral violence, Kathleen F. Klaus analyzes violence as a process of mobilization that requires coordination between elites and ordinary citizens. Drawing on fifteen months of fieldwork in Kenya, including hundreds of interviews and an original survey, Political Violence in Kenya argues that where land shapes livelihood and identity, and tenure institutions are weak, land, and narratives around land, serve as a key device around which elites and citizens coordinate the use of violence. By examining local-level variation during Kenya's 2007-8 post-election violence, Klaus demonstrates how land struggles structure the dynamics of contentious politics and violence.

Abstract

This book explores the history of public land tenure records, which first began in colonial Massachusetts as English settlers and Native Americans tried to resolve differing ideas about rights to land in the seventeenth century. In South Australia, a similar method of state certification of land ownership arose in the nineteenth century, through Torrens system title registration – a process that would be widely adopted in British and American colonies as a particularly effective way of guaranteeing absolute ('fee simple') ownership over indigenous peoples’ land. This book explores the similarities between these two record systems, highlighting how similar settlement patterns and religious beliefs in both places focused attention on recording land tenure, and illustrating how these record systems encouraged new ways of thinking about rights to and on land. .

In Volume I of A Separate Authority (He Mana Motuhake), Steven Webster provides an ethnohistorical reconstruction of the establishment in New Zealand of a rare case of Maori home-rule over their traditional domain, backed by a special statute and investigated by a Crown commission, the majority of whom were Tūhoe leaders. This relatively benevolent colonial policy enabled the Tūhoe to control the establishment of their vast Native Reserve in a way that entrenched their social organisation, particularly their traditional deployment of kin-based power, while at once manipulating the power of the Crown to their joint advantage from 1894 to 1908. In Volume II, Webster documents how this same form of resistance enabled the Tūhoe to withstand predatory Crown policies between 1908 and 1926, thereby retaining remnants of their ancestral sanctuary—which later became the basis upon which they won statutory control of the territory.

Abstract

One of the most important manuscripts surviving from thirteenth-century England, the corpus of documents known as the Hundred Rolls for Cambridge have been incomplete until the recent discovery of an additional roll. This invaluable volume replaces the previous inaccurate transcription by the record commission of 1818 and provides new translations and additional appendices. Shedding new light on important facets of business activity in thirteenth-century Cambridge, this volume makes a significant contribution to our knowledge of the early phases of capitalism. Abstract

"This book presents the results of the first systematic archaeological study of Roman peasants. It examines the spaces, architecture, diet, agriculture, market interactions and movement habitus of non-elite rural dwellers in a region of southern Tuscany, Italy, during the Roman period. The first half of the book presents the excavation data from eight non-elite rural sites including a farm, a peasant house, animal stall/work huts, a ceramics factory, field drains and a site of uncertain function, here framed as individual chapters complete with finds analysis. The second half of the book examines this data synthetically in thematic chapters addressing land use, agriculture, diet, markets and movement. The results suggest a different, more sophisticated Roman peasant than heretofore assumed. The data suggests that Roman peasants in the 1st c. BC/AD particularly built specialized sites distributed throughout the landscape to maximize use of diverse land parcels. Movement studies, based on finds from the sites themselves, describe a more mobile population that previously assumed, engaged in quotidian and long-distance movement patterns, data supported by the small but steady stream of imports and exports into and out of this seemingly liminal region. The book concludes by addressing the implications of this new data for major questions in Roman social and economic history"-- This has important implications for the interpretation of field survey data, estimate of rural demographics from that survey and assumption about the long-term changes to human settlement. It also points to an important moment of agricultural intensification in this period, a contention beginning to be supported by other studies. The project also identified sophisticated systems of land use, including crop rotation and an important investment in animal agriculture. The data similarly present the first systematic data from Roman Italy for rural consumption, tracking the fine wares produced at a production site to local sites nearby. This supports the largely theoretical new work problematizing the so-called consumer city model and suggests the potential importance of rural aggregate demand.
