This book explores the meaning and implementation of international children’s rights law, as laid down in the United Nations Convention on the Rights of the Child and related international and regional human rights instruments. It considers the application of international children’s rights at the national level and addresses key procedural and institutional matters concerning children’s rights implementation, including monitoring, complaints mechanisms, effective remedies, advocacy and international agenda-setting. The book breaks new ground by analysing a wide range of international children’s rights issues from a legal perspective. It incorporates a comparative perspective on children’s rights law at the international, regional and domestic level and contains information on evidence-based strategies towards the implementation and enforcement of international children’s rights law. Which law applies to armed conflict? This book investigates the applicability of international humanitarian law and international human rights law to armed conflict situations. The issue is examined by three scholars whose professional, theoretical, and methodological backgrounds and outlooks differ greatly. These multiple perspectives expose the political factors and intellectual styles that influence scholarly approaches and legal answers, and the unique trialogical format encourages its participants to decenter their perspectives. By focussing on the authors' divergence and disagreement, a richer understanding of the law applicable to armed conflict is achieved. The book, firstly, provides a detailed study of the law applicable to armed conflict situations. Secondly, it explores the regimes' interrelation and the legal techniques for their coordination and prevention of potential norm conflicts. Thirdly, the book moves beyond the positive analysis of the law and probes the normative principles that guide the interpretation, application and development of law.

This book introduces readers to the major human rights institutions, courts, and tribunals and critically assesses their legacy as well as the promise they hold for realizing human rights globally, and the challenges they face in doing so. It traces the rationale of setting up international institutions, courts, and tribunals with the aim of ensuring respect for international human rights law and presents their historic development, and critically analyzes their contribution to the promotion and protection of human rights. At the same time, it asks which promises old and new (and envisaged) human rights institutions hold for safeguarding human rights in light of continuing violations and recent global trends in human rights and politics. The first section presents institutions created within the framework of the United Nations. The second part of the volume assesses how international criminal tribunals have reframed human rights violations as individual criminal acts. The third part of the volume is devoted to established and emerging regional human rights bodies and courts around the world.

This book investigates whether so-called rogue states – assumed antagonists of a Western-liberal world order – could also act as norm entrepreneurs by championing the genesis and evolution of global norms. The author explores this issue by analyzing the arms control policies of the Islamic Republic of Iran. A comparison with the prototypical norm entrepreneur Sweden and the Democratic People’s Republic of North Korea – a notorious norm-breaker – reveals interesting insights for norm research: Apparently, norm entrepreneurship manifests itself in different degrees and phases of the norm life cycle. The finding that Iran indeed acts as a norm entrepreneur in some cases also sheds light on those factors that might account for the success or failure of norm advocacy. This book provides an in-depth investigation of citizenship and nationalism in connection with the Rohingya community. It analyses the processes of production of statelessness in South Asia in general, and with regard to the Rohingyas in particular. Following the persecution of the Rohingya community in Myanmar (Burma) by the military and the Buddhist militia, a host of texts, mostly descriptive, have examined the historical, political and cultural roots of the genocidal massacre and the flight of its victims to South Asia and South-East Asian countries. The UNHCR reports describe the plight of Rohingyas during and after their journey, while other works focus on the political-economic roots of this ethnic conflict and its consequences for the Rohingyas. To date, very few theoretical insights have been provided on the Rohingya issue. This book seeks to fill that gap, and explores a dialogue between the state and its citizens and non-citizens that results in the production of statelessness. In theoretical terms, the book addresses the construction of citizens and non-citizens on the part of the state, and the process of symbolic othering, achieved through various state practices couched in terms of nationalism. Extensive case studies from India, Myanmar and Bangladesh provide the foundation for a robust theoretical argument. Given its scope, the book will be of interest to students, academics and researchers with a focus on political economy in South Asia in general and/or refugee studies in particular.
