Ouvrage issu du colloque organisé le 7 juin 2019 par l'Idetcom à Toulouse. 0Le statut juridique de l'image des biens publics culturels prend forme progressivement sous l'effet conjugué de la jurisprudence administrative et constitutionnelle récente et de la réforme effectuée par la loi LCAP en 2016 dans un contexte qui invite désormais à un dialogue entre spécialistes du droit public et du droit privé. 0Ce cadre juridique soulève nombre d'interrogations pour la propriété publique, le patrimoine immatériel des personnes publiques, sa valorisation économique, mais aussi quant à l'élaboration d'un régime juridique de l'exploitation de l'image soumis au droit privé dans lequel le droit de la propriété intellectuelle prend le relais du droit public, ou encore à propos du régime de responsabilité à forger en cas d'utilisation anormale de l'image d'un bien public culturel par un tiers.0La réflexion invite ainsi à un regard croisé des universitaires et des professionnels, spécialistes du droit des biens publics, du droit de la culture et du droit privé, en forme de bilai mais aussi afin de tracer des perspectives pour mieux cerner le cadre juridique de l'image des biens publics."

Ever since the adoption of the Universal Declaration of Human Rights in 1948 there has been a debate on the issue of universality and cultural diversity. Nowadays, this debate is not so much framed in terms of opposites, but more in terms of reconciliation.00Under the international human rights framework, States are allowed to take cultural particularities into account when implementing the treaties. The UN human rights treaty bodies which monitor the implementation of the treaties by States have an important role to play in ensuring a proper balance between safeguarding the universality of the rights, while at the same time leaving room for cultural particularities in the interpretation and implementation of those rights by States. This book examines how the UN treaty bodies, in particular the Human Rights Committee, the Committee on Economic, Social and Cultural Rights and the Committee on the Elimination of Discrimination against Women, fulfil this role.00The research shows that human rights are used as a sword to protect and safeguard culture and cultural diversity, and as a shield to protect against harmful aspects of culture. It also looks in-depth at the dialogue between treaty bodies and States parties, and the way cultural arguments are dealt with. The study concludes that the treaty bodies are first and foremost guardians of the universality of human rights. They use their monitoring role not so much (actively) to reconcile universality and cultural diversity or to accommodate cultural variation, but more to determine the limits of such cultural variation.

While armies have seized enemy records and rare texts as booty throughout history, it was only during World War II that an unlikely band of librarians, archivists, and scholars traveled abroad to collect books and documents to aid the military cause. Galvanized by the events of war into acquiring and preserving the written word, as well as providing critical information for intelligence purposes, these American civilians set off on missions to gather foreign publications and information across Europe. They journeyed to neutral cities in search of enemy texts, followed a step behind advancing armies to capture records, and seized Nazi works from bookstores and schools. When the war ended, they found looted collections hidden in cellars and caves. Their mission was to document, exploit, preserve, and restitute these works, and even, in the case of Nazi literature, to destroy them. In this fascinating account, cultural historian Kathy Peiss reveals how book and document collecting became part of the new apparatus of intelligence and national security, military planning, and postwar reconstruction. Focusing on the ordinary Americans who carried out these missions, she shows how they made decisions on the ground to acquire sources that would be useful in the war zone as well as on the home front. These collecting missions also boosted the postwar ambitions of American research libraries, offering a chance for them to become great international repositories of scientific reports, literature, and historical sources. Not only did their wartime work have lasting implications for academic institutions, foreign-policy making, and national security, it also led to the development of today's essential information science tools. Illuminating the growing global power of the United States in the realms of intelligence and cultural heritage, Peiss tells the story of the men and women who went to Europe to collect and protect books and information and in doing so enriches the debates over the use of data in times of both war and peace.

Een belangrijke rol is in het boek weggelegd voor de achttiende-eeuwse filosoof Immanuel Kant en zijn denken over verbeelding. Met dit boek wil Onno Zijlstra ons verleiden tot kijken, opnieuw kijken en nog eens kijken.
