Les faits justificatifs spéciaux sont ici définis et identifiés comme des causes objectives d'irresponsabilité pénale affectées à une ou quelques infractions précises, et prévues - sauf pour les faits justificatifs prétoriens - par un texte lui-même affecté à la fonction justificative. Cette unité n'est toutefois qu'apparente. L'étude de la justification spéciale met en exergue l'éclatement conceptuel et l'enchevêtrement normatif qui caractérisent le droit contemporain. Parce qu'ils sont si discrets à l'échelle de la répression pénale, parce qu'ils n'ont pour garantir leur intégrité ou leur cohérence ni principe cardinal, ni institution dédiée, les faits justificatifs spéciaux ont été entraînés sans résistance par le courant puissant des faits divers, des aléas politiques, des réformes institutionnelles et des espoirs européens. Leur étude permet ainsi d'étoffer la réflexion doctrinale sur la redéfinition jurisprudentielle des infractions, sous l'influence de la Cour européenne des droits de l'homme, et de revenir sur le dévoiement de la norme pénale instrumentalisée par d'autres domaines juridiques à la recherche de symbolisme, et participant ainsi à l'expansion du droit pénal sanctionnateur. Qu'ils pointent du doigt la jurisprudence ou le faiseur de lois, les faits justificatifs spéciaux trahissent par leur modestie et leur petitesse la démesure des ambitions des acteurs institutionnels du droit pénal.

Life in political society unfolds within the bounds of a narrow circle, epistemic and moral. A person has only finite faculties and restricted moral motivation. When formulating projects, the person ought to recognize these limits but also to check them. Accordingly, she seeks a deliberative ideal which is sensitive both to good epistemic practice and to respectful relations. How might the person best justify the shape of her society’s institutions, statutes and policies? What reflexive attitudes and dispositions ought she to adopt towards her justificatory resources? The person might work through the sequence of standpoints from John Rawls’s “political liberalism”: a first-person, action-guiding framework of deliberation and reflection. Alternatively, she might model the exploratory discourse and personal virtues characteristic of Jeffrey Stout’s “democratic traditionalism”. This work reconstructs Rawls’s and Stout’s approaches to justification, discourse and institutions and compares their differing methods in search of the most adequate deliberative ideal for democratic society

Elle prévoit de consacrer légalement la pratique jurisprudentielle en matière de légitime défense et de créer l’excès de légitime défense comme nouvelle cause d’excuse atténuante générale. La présente contribution vise à effectuer une analyse critique de droit comparé de cette réforme au regard des droits français, néerlandais et allemand.
