Bien que relevant, l'un du droit public, l'autre du droit privé, le droit de l'urbanisme et le droit de la construction ont des objets proches : ils concernent l'un et l'autre l'occupation de l'espace par les implantations humaines, ils régissent l'un et l'autre notre cadre de vie. L'ouvrage présente ces deux droits dans l'état d'équilibre plus ou moins stable où ils sont aujourd'hui, après les multiples réformes dont ils ont fait l'objet depuis quelques décennies. La première partie analyse le droit de l'urbanisme (cadres de l'intervention de la puissance publique en matière d'urbanisme, réglementation d'urbanisme, intervention foncière, opérations d'aménagement urbain, contrôle de l'utilisation des sols). Pour son 12e colloque biennal, organisé à Trèves les 20 et 21 septembre 2019, l’Association internationale de droit de l’urbanisme s’est intéressée à l’important thème de la mobilité urbaine.Le présent ouvrage est le fruit des travaux du colloque. Une introduction générale et un rapport spécifique ont pour objet de circonscrire le champ et les enjeux du sujet retenu. Suivent divers rapports thématiques sur la question de savoir qui détient les compétences appelées à devoir être exercées pour assurer la mobilité urbaine, sur le point de savoir quelles sont les autorisations qui doivent être délivrées et les procédures qui doivent être suivies, sur l’articulation entre la politique de mobilité urbaine et la politique d’urbanisme, sur l’articulation entre la politique de mobilité urbaine et la politique de protection de l’environnement, ainsi que sur l’articulation entre la politique de mobilité urbaine et les questions de circulation et de stationnement. Un rapport de synthèse ponctue l’ensemble, en vue d’en présenter les principaux axes de réflexions.Sont publiés, à leur suite, les douze rapports nationaux qui ont fourni la substance des travaux thématiques et de synthèse. This book adds a critical perspective to the legal dialogue on the regulation of ‘smart urban mobility’. Mobility is one of the most visible sub-domains of the ‘smart city’, which has become shorthand for technological advances that influence how cities are structured, public services are fashioned, and citizens coexist. In the urban context, mobility has come under pressure due to a variety of different forces, such as the implementation of new business models (e.g. car and bicycle sharing), the proliferation of alternative methods of transportation (e.g. electric scooters), the emergence of new market players and stakeholders (e.g. internet and information technology companies), and advancements in computer science (in particular due to artificial intelligence). At the same time, demographic changes and the climate crisis increase innovation pressure. In this context law is a seminal factor that both shapes and is shaped by socio-economic and technological change. This book puts a spotlight on recent developments in smart urban mobility from a legal, regulatory, and policy perspective. It considers the implications for the public sector, businesses, and citizens in relation to various areas of public and private law in the European Union, including competition law, intellectual property law, contract law, data protection law, environmental law, public procurement law, and legal philosophy.
