Abstract

The world of law has changed in the last decades: it has become more globalized, multilingual and digital. The sections and contributions of this volume continue the interdisciplinary discussion about the challenges of this change for theory and practice of law and for the International Language and Law Association (ILLA) relaunched in 2017. First, the book gives a broad overview to the research field of legal linguistics, its history, research directions and open questions in different parts of the world (United States, Africa, Italy, Spain, Germany, Nordic countries and Russia). The second section consists of contributions about the relation of language, law and justice in a globalized world with a focus on multilingual and supranational law in the EU. The third section focuses on digitalization and mediatization of the law, the last section reports about the discussion at the ILLA relaunch conference in 2017.

Abstract

Over the past few years, increased 'unauthorised' migrations into the territories of Europe have resulted in one of the most severe crises in the history of the European Union. Stierl explores migration and border struggles in contemporary Europe and the ways in which they animate, problematise, and transform the region and its political formation. This volume follows public protests of migrant activists, less visible attempts of those on the move to 'irregularly' subvert borders, as well as new solidarities and communities that emerge in interwoven struggles for the freedom of movement. Stierl offers a conceptualisation of migrant resistances as forces of animation through which European forms of border governance can be productively explored. As catalysts that set socio-political processes into frictional motion, they are developed as modes of critical investigation, indeed, as method. By ethnographically following and being implicated in different migration struggles that contest the ways in which Europe decides over and enacts who does, and does not, belong, the author probes what they reveal about the condition of Europe in the contemporary moment. This work will be of great interest to students and scholars of Migration, Border, Security and Citizenship Studies, as well as the Political Sciences more generally.

Abstract

The modern liberal idea of citizenship is constructed by a fixed notion of identity which gains meaning through a number of binary oppositions, such as we/ they, citizen/ foreigner, self/ other and so forth. Defined by these binaries, where the first term is perceived as dominant because it is considered to be derived from reason, the fixed notion of identity inevitably produces exclusion and marginalization. Importantly, the postmodern concept of citizenship stems from a critique of these essentialist and universalist conceptions of identity.Exploring European identity and European citizenship from a philosophical perspective, this book reveals the discursive construction of these two concepts whilst at the same time attempting to define them as either modernist or postmodernist categories. Dr. Ivic takes a hermeneutic approach in her interpretation of European citizenship and identity through a close reading of European treaties and other official documents. Through her detailed analysis, Dr. Ivic is able to present the reader with well-informed and concrete examples of modern and postmodern concepts of identity within Europe. Moreover, this book explores the impact that contemporary issues such as Brexit, the migration crisis in Europe, and the proliferation of nationalist discourses, have on European citizenship and identity.Where existing research literature has failed, this book offers a dynamic and textual analysis of citizenship that takes into account the complex philosophical, legal, political and theoretical background of Europe. Abstract

Long description: Legislation is characterized by a high degree of linguistic conservatism. So, despite existing EU and national guidelines, inclusive choices are still limited in legislation at both levels. An introduction to the topic of gender in language and in legal language opens the volume, focusing on the EU dimension and on the language policies of England, France, Germany, Italy and Spain. In the following, five sociolinguistic contexts are described, and three Romance, and two Germanic linguistic traditions are compared through qualitative and quantitative corpus analyses based on the same corpora and consistent methodological guidelines. These studies aim at highlighting the presence or absence of a gender-neutral language in European and national laws. Biographical note: Stefania Cavagnoli is Associate Professor in Applied Linguistics at Università di Roma Tor Vergata and director of her University’s Language Center. Laura Mori is associate professor of Linguistics at the Faculty of Interpreting and Translation of the Università degli Studi Internazionali di Roma (UNINT) where she teaches Sociolinguistics and Text Linguistics and Pragmatic.

Abstract

In 2008 the world experienced the Great Recession, a financial and economic crisis of enormous proportions and the greatest economic downturn since the 1930s. In its wake, unemployment became a key preoccupation of West European publics and politicians. This comparative study considers the policy debates surrounding unemployment in the United Kingdom, Germany, France, Italy, Denmark and Switzerland since 2008. With an over-arching focus on drawing out cross-national commonalities and differences, the authors ask whether patterns of political communication vary across countries. Their analysis draws on interviews with labour market policy-makers in the six selected countries, and paints a revealing picture. Appealing to researchers in comparative politics, political communication and welfare state research, this book will also interest practitioners involved in labour market policy.

Abstract

Sergio Fabbrini proposes a way out of the EU's crises, which have triggered an unprecedented cleavage between 'sovereignist' and 'Europeanist' forces. The intergovernmental governance of the multiple crises of the past decade has led to a division on the very rationale of Europe's integration project. Sovereignism (the expression of nationalistic and populist forces) has demanded more decision-making autonomy for the EU member states, although Europeanism has struggled to make an effective case against this challenge. Fabbrini proposes a new perspective to release the EU from this predicament, involving the decoupling and reforming of the EU: on the one hand, the economic community of the single market (consisting of the current member states of the EU and of others interested in joining or re-joining it); and on the other, the political union (largely based on the eurozone reformed according to an original model of the federal union).

Abstract

Several Member States of the European Union have concluded treaties and conventions with Third States dealing with questions of succession law in cross-border matters. Some of these treaties originate from the beginning of the 20th century and are outdated. The European legislator, however, cannot supersede these treaties and conventions unilaterally with its regulations, in fact they enjoy priority over the European Succession Regulation. The harmonizing effect of European private international law is hence endangered, the more so, as these treaties and conventions often cover large groups of third State nationals in the respective Member State. This book analyzes the background, scope and practical impact of bilateral treaties and multilateral conventions concluded by selected Member States of the European Union with third States, both from the European and the third State perspective. It evaluates the impact of these treaties and conventions on the functioning of the European Succession Regulation and the possibilities to facilitate the interplay between these instruments and European private international law. Anatol Dutta holds a Chair of Private Law, Private International Law and Comparative Law at the Ludwig Maximilians University Munich. Wolfgang Wurmnest holds the Chair of Private Law, Commercial Law, Private International and Comparative Law at the University of Augsburg.

Abstract

How Europe can hit the reset button after years of failed responses to North African turmoil. The ongoing upheaval in North Africa has presented many challenges to Europe, which previously had been comfortable with the status quo of authoritarian leadership in much of the region. Now in its ninth year, the turmoil has forced European leaders to rethink their approaches to the region, based on the now-obvious reality that the brief hopes of early 2011 for the spread of democracy and economic progress will not be fulfilled anytime soon. In this book, experts from Europe, the United States, and the Middle East discuss what has happened since the so-called Arab Spring emerged and how those often-bewildering events have affected both North Africa and the European states across the Mediterranean. The book is based on papers presented at a March 2018 conference sponsored by the South Mediterranean Regional Program of the Konrad Adenauer Stiftung. Chapters focus on events in Algeria, Egypt, Libya, Morocco, and Tunisia-and offer ideas for how the European Union can adopt fresh approaches to the region, moving beyond its frequently uncertain and shifting responses of recent years.
