"On May 10, 1776, the Second Continental Congress sitting in Philadelphia adopted a Resolution urging each of the British colonies in North America "to adopt such government as shall . . . best conduce" in response to the impending crisis with Great Britain. A suitable preamble was passed on the May 15 following, and Congress then directed that the document be released to the public. The Resolution of May 15 set in motion a round of constitution making in the colonies, several of which soon declared themselves sovereign states and severed all remaining ties to the British Crown. In forming these written constitutions, the delegates to the state conventions were forced to address the issue of church-state relations. Each colony had unique and differing traditions of church-state relations rooted in the colony's peoples, their country of origin, and religion, and the state constitutional framers had to confront the issue of religion, which many would have preferred to put off. This unique volume, comprising twenty-one original essays by eminent historians and political scientists, is a state-by-state account of disestablishment in the original thirteen states, as well as a look at similar events in the soon-to-be-admitted states of Vermont, Tennessee, and Kentucky. Also considered are disestablishment in Ohio (the first state admitted from the Northwest Territory), Louisiana and Missouri (the first states admitted from the Louisiana Purchase), and Florida (wrestled from Spain under U.S. pressure)"--

Geschichtliche Prozesse und gegenwärtige Phänomene werden unter der Perspektive von "Säkularisierung" beschrieben und gewinnen so ein besonderes Profil. Was aber steckt hinter der Begrifflichkeit und mit welchen Theorien und Theorieentwicklungen sind wir konfrontiert? Die Beiträge dieses Bandes versuchen dies zu klären und sowohl historische als auch gegenwartsbezogene Zugänge zu entwickeln. Dabei geht es um Säkularisierungsschübe und deren Auslöser in der Geschichte; um die Frage danach, wie Religion und religiöse Praxis in jeweils unterschiedlicher Weise auf Säkularisierungsphänomene reagierten. Denn Tatsache ist, dass die Religion - in welcher Ausprägung auch immer - nie ganz verdrängt wurde. Auch die Auswirkungen von Säkularisierung und Säkularisierungsschüben auf die gelebte Religion werden thematisiert, ebenso wie mögliche gesellschaftliche und politische Auswirkungen. Kam es zu einer Verdrängung der Religion aus der Öffentlichkeit oder zu einer Selbstbehauptung der Religion gegen säkularisierende Tendenzen? Much has been written on specific religious legal systems, yet substantial comparative studies that strive to compare systems, identifying their analogies and differences, have been relatively few. This absence undermines the capacity to understand religions and becomes particularly serious when the faithful of these religions live together in the same geographical space, as happens today with increasing frequency. Both interreligious dialogue and dialogue between States and religions presuppose a set of data and information that only comparative research can provide. This book seeks to address this gap in the literature by presenting a comparative analysis of Christian, Jewish, Islamic and Hindu laws and traditions. Divided into five parts, the firstpart of the book offers the historical background for the legal analysis that is developed in the subsequent parts. The long twelfth century heralded a fundamental transformation of monarchical power, which became increasingly law-based and institutionalised. Traditionally this modernisation of kingship, in conjunction with the ecclesiastical reform movement, has been seen as sounding the death knell for sacral kingship. Increasingly concerned with bureaucracy and the law, monarchs supposedly paid only lip service to the idea that they ruled in the image of God and the Old Testament rulers of Israel. The liturgical ceremony through which this typology was communicated, inauguration, had become a relic from a bygone age; it remained significant, but for its legally constitutive nature rather than for its liturgical content. Through a groundbreaking comparative approach and an in-depth engagement with the historiographical traditions of the three realms, this book challenges the paradigm of the desacralisation of kingship and demonstrates the continued relevance of liturgical ceremonial, particularly at the moment of a king's accession to power. In integrating the study of male and female rites and by bringing together multiple source types, including liturgical texts, historical narratives, charter evidence and material culture, the author demonstrates that the resonances of liturgical ceremonial, and the biblical models for kingship and queenship it encompassed, continued to shape concepts of rulership in the high Middle Ages.

Historians commonly designate the High Middle Ages as the era of the "papal monarchy," when the popes of Rome vied with secular rulers for spiritual and temporal supremacy. Indeed, in many ways the story of the papal monarchy encapsulates that of medieval Europe as often remembered: a time before the modern age, when religious authorities openly clashed with emperors, kings, and princes for political mastery of their world, claiming sovereignty over Christendom, the universal community of Christian kingdoms, churches, and peoples. At no point was this conflict more widespread and dramatic than during the papacies of Gregory IX (1227-1241) and Innocent IV (1243-1254). Their struggles with the Hohenstaufen Emperor Frederick II (1212-1250) echoed in the corridors of power and the court of public opinion, ranging from the battlefields of Italy to the streets of Jerusalem. In The Two Powers, Brett Edward Whalen has written a new history of this combative relationship between the thirteenth-century papacy and empire. Countering the dominant trend of modern historiography, which focuses on Frederick instead of the popes, he redirects our attention to the papal side of the historical equation. By doing so, Whalen highlights the ways in which Gregory and Innocent acted politically and publicly, realizing their priestly sovereignty through the networks of communication, performance, and documentary culture that lay at the unique disposal of the Apostolic See. Catherine Maire avait consacré un livre qui a fait date, il y a vingt ans, au jansénisme au XVIIIe siècle, De la cause de Dieu à la cause de la Nation. Elle élargit ici son enquête à l'ensemble des affaires politico-religieuses qui ont scandé le siècle, de la bulle Unigenitus (1713) qui condamne le jansénisme et devient une loi du royaume en 1730 à la Constitution civile du clergé, en 1790, pendant la Révolution. In doing so, they shed new light on the fascinating stories of these unruly women whose fates have been excluded from Catholic and women narratives of the period. The result is a work which considers the questions of religious sainthood and martyrdom through a gender lens, providing important insights into the relationship between society, the state and the church in Britain during the 16th century. The rise of the Capetian dynasty across the long thirteenth century, which rested in part on the family's perceived sanctity, is a story most often told through the actions of male figures, from Louis IX's metamorphosis into "Saint Louis" to Philip IV's attacks on Pope Boniface VIII. In Courting Sanctity, Sean L. Field argues that, in fact, holy women were central to the Capetian's self-presentation as being uniquely favored by God. Tracing the shifting relationship between holy women and the French royal court, he shows that the roles and influence of these women were questioned and reshaped under Philip III and increasingly assumed to pose physical, spiritual, and political threats by the time of Philip IV's death. Field's narrative highlights six holy women. The saintly reputations of Isabelle of France and Douceline of Digne helped to crystalize the Capetians' claims of divine favor by 1260. In the 1270s, the French court faced a crisis that centered on the testimony of Elizabeth of Spalbeek, a visionary holy woman from the Low Countries. After 1300, the arrests and interrogations of Paupertas of Metz, Margueronne of Bellevillette, and Marguerite Porete served to bolster Philip IV's crusades against the dangers supposedly threatening the kingdom of France. Courting Sanctity thus reassesses key turning points in the ascent of the "most Christian" Capetian court through examinations of the lives and images of the holy women that the court sanctified or defamed.
