Le présent projet de recherche tend à apporter une solution a priori nouvelle au problème posé par la criminalité organisée au sein des Etats membres de l'Union européenne. S'appuyant sur certaines recherches en criminologie, l'auteur soulignera dans une première partie du travail le caractère économique substantiel des principaux secteurs d'activités du crime organisé et la nécessité de faire en sorte que les pouvoirs publics combattent ou supplantent l'offre criminelle par la voie économique plutôt qu'en tentant de pénaliser la demande de leurs citoyens. L’auteur en arrivera à étudier la possibilité d’un monopole national relatif aux drogues. Dans une deuxième partie, l'auteur adoptera une approche visant à intégrer ledit monopole au sein du droit de l’Union européenne. Une distinction sera ainsi opérée entre une phase de court terme, dite phase monopolistique quasi-souveraine, et une phase de long terme, dite phase d’intégration progressive. L’auteur étudiera d’abord les compétences de l’Union européenne et les conventions internationales venant faire obstacle au projet d’intégration européenne. Ensuite, les règles relatives au droit de la concurrence, à la libre circulation des marchandises, aux aides d’Etat, aux services d’intérêt économique général et aux monopoles nationaux à caractère commercial seront analysées dans le cadre de la première phase. Dans le cadre de la seconde phase, l’auteur étudiera de multiples hypothèses d’intégration positive du nouveau marché des drogues au sein de l’Union européenne.
