Abstract

In Slovenia, attorneys as a part of the justice system represent an autonomous and independent service that is regulated by law. As set out in the decision of the Constitutional Court of the Republic of Slovenia, there is no doubt that the legislature has to adopt the law to regulate the attorneys' profession, but in its attempt of such regulation, the legislature always collides with the constitutional requirement that the attorneys are autonomous and independent. Therefore, when regulating the attorneys' profession, the legislature has to address the issues of autonomy and independence and thus also the question of determining attorney tariffs, while certain issues must be left to be autonomously regulated within the attorneys' profession. The attorney tariff does not determine a mandatory price of legal services because an attorney and his client may always reach an agreement that is different from the attorney tariff. However, the tariff is binding when the court decides on the obligation to reimburse the party who has succeeded in a dispute for their attorney costs. With our research, we have empirically demonstrated that the existing attorney tariff in Slovenia unjustifiably drains smaller law firms, which guarantee an efficient coverage of population and smaller undertakings with a network of legal services. As a result, the economic autonomy and independence of law firms are compromised, and the right to effective judicial protection is unjustifiably restricted for the parties who succeed in a dispute.

Abstract

The present volume is a collection of articles published in English by Professor Pierre Briant of the Collège de France, in various forms over the past three decades. Pierre Briant has been instrumental in the recent revival of Achaemenid history, and the way in which he has achieved this is instructive for the future generations of historians to come. One can state that Briant's approach to history is very much in the French tradition: it engages with both narration and a thorough historiographical methodology, making his work so distinctively rigorous and compelling at the same time. Another important contribution made by Briant's work concerns the changing scholarly interpretations of the relations between the Achaemenids and Alexander in the longue durée. Since the major corpus of Pierre Briant's work was originally composed in French, I thought that it would be beneficial to many English-speaking students, as well as educated readers and experts in the field, to have access to these important essays in a single volume. I have tried to keep articles in their original publication format and style, wherever possible. This volume is a special tribute to an important historian of our time, from which current and future students of Persia will have much to learn. This volume was previously published by the Jordan Center for Persian Studies, University of California - Irvine.

Abstract

This volume tries to tackle the most serious problem facing modern Alexander the Great studies: that of inadequate sources. Its principal interest is in surviving ancient continuous accounts (Diodorus, Curtius Rufus, Plutarch, Arrian, and Justin), which are at least three hundred years younger than Alexander and in many ways one-sided in their Greek bias, often promoting the view of Alexander within the narrow bounds of a Western conqueror. The papers in this volume deconstruct these accounts and search for sources used by their authors, principally in narrative of eye-witnesses and other authors of the first generation after Alexander, including his court historian Callisthenes and his companions Onesicritus, Aristobulus, and Ptolemy. They search for fragments of ancient literary works known from papyri and for shadowy accounts created on the Persian side like the “mercenaries’ source”. Some papers look into propaganda patterns of the age of Alexander and their connections with clichés of Egyptian literature. Some investigate a parallel tradition on the last will of Alexander, enshrined in I Maccabees, and best known from the Alexander Romance. Finally, papers in this volume examine post-classical rendition of Alexander: Jewish from the Talmud to Josippon and Byzantine, composed of separate textual traditions of various ancient authors, with Plutarch taking pride of place
