Abstract

Sajó and Uitz's intellectual history of the constitutional ideal is rich in contextual detail and informed by case studies that give an overview of both the theory and practice of constitutionalism worldwide. Si l'objet de l'ordonnance n° 2016-131 du 10 février 2016 portant réforme du droit des contrats, du régime général et de la preuve des obligations ne porte en principe que sur le droit commun des contrats, celle-ci ne pouvait néanmoins rester sans incidence sur le droit des contrats spéciaux.L'influence de la réforme est ainsi présente à tous les stades de la vie de ces contrats.Tout d'abord, en matière de qualification, soit que de nouveaux contrats spéciaux fassent leur apparition - tels le contrat d'adhésion et le contrat de prestation de service - soit qu'une nouvelle définition soit donnée à un contrat déjà présent dans le Code civil - le contrat aléatoire.Ensuite, c'est le régime de certains contrats spéciaux qui est renouvelé par la réforme. Ainsi en est-il du contrat de prêt pour lequel la cause jouait un rôle central, cause qui a été supprimée dans les nouvelles dispositions du droit commun des contrats. Le prêt serait-il désormais un contrat sans cause ? De même, les contrats préparatoires à la vente sont codifiés en partie pour modifier profondément le régime juridique de leurs sanctions, tel que défini par la jurisprudence.Dans un mouvement d'influence inverse, c'est le régime du contrat de mandat qui a largement inspiré les nouvelles dispositions sur le droit commun de la représentation qui, à son tour, a permis de clarifier et d'améliorer le régime applicable à ce contrat.Par ailleurs, en créant des contrats jusqu'alors inédits, le contrat de prestation de service et celui d'adhésion, la réforme les a dotés chacun d'un embryon de régime juridique très controversé.Enfin, des dispositions générales font leur apparition dans le Code à propos des restitutions, qui ne resteront pas sans incidence sur celles dues à la suite de l'anéantissement de la vente.

Abstract

Europe is in crisis. With rising unrest among citizens of EU member states exemplified by the UK's decision to leave the EU, and the growing popularity of anti-EU political parties, Dieter Grimm presents the argument that Europe has to change its method of further integration or risks failure. This book, containing essays many of which have not been published in the English language to date, explores how the EU has become over-constitutionalized. Grimm argues that this has left the EU with a democratic deficit leading to the alienation of citizens. This book highlights Europe's democracy problem. The most prominent argument running throughout is that the EU and its decision-making processes have become over-constitutionalized. This is due to the constitutionalization of European treaties, which has occurred by raising them to the eminence of a constitution as a result of the jurisprudence of the European Court of Justice. However, the treaties contain provisions that would be ordinary law in member states. The fact that they enjoy constitutional status in Europe detaches them from the democratic processes in the member states and the EU itself, and contributes to the growing independence of the EU's executive and judicial institutions
