L'ouvrage a pour objet l'étude du droit de l'Union européenne. Plus qu'une organisation internationale sans être un État, l'Union européenne présente une nature spécifique originale. Ainsi que la Cour de justice de l'Union européenne l'a affirmé, elle est dotée d'un ordre juridique d'un genre nouveau, d'un cadre constitutionnel et de principes fondateurs qui lui sont propres, d'une structure institutionnelle particulièrement élaborée ainsi que d'un ensemble complet de règles juridiques qui en assurent le fonctionnement. L'ouvrage se compose ainsi de quatre parties qui permettent de comprendre les caractéristiques fondamentales et le système institutionnel de l'Union européenne ainsi que l'ordre juridique de l'Union et l'Union de droit. Fruit d'un processus d'intégration communautaire, l'Union européenne est ponctuée de crises qui, loin d'en signifier la fin, en perpétuent le renouvellement. Ainsi que le Brexit le révèle, la question n'est pas celle de savoir si l'Union européenne a un avenir, mais de choisir quel projet d'intégration constitutionnelle on entend porter. Le droit de l'Union européenne est donc un droit bien vivant dont l'étude est plus que jamais indispensable.

Mit dem Geburtstagszug-Urteil hat der Bundesgerichtshof das Erfordernis einer besonderen Schöpfungshöhe für Werke der angewandten Kunst aufgegeben. Nun gilt auch hier derselbe Maßstab wie bei der reinen Kunst. Lukas Mezger untersucht diese neue Schutzschwelle und praktisch handhabbare Kriterien. Besonderes Augenmerk liegt auf den Vorgaben des europäischen Rechts. Dabei wird deutlich, dass den Ausschließlichkeitsrechten des Urheberrechts und seiner langen Schutzdauer ein hohes Freihaltebedu?rfnis gegenübersteht. Dieser Konflikt kann allein durch einen engen Schutzbereich nicht aufgelöst werden. The EU is committed to the construction of an internal market: this book examines what the concept of the ‘internal market’ means. The book’s account and analysis of the law is built on the claim that the EU ‘internal market’ is an ambiguous legal concept. One may readily suppose that the UK possesses an internal market. So does Germany, so does France, so does Australia and Canada and the USA, and so on. And the EU aspires to an internal market. But the detailed patterns governing these several internal markets are not uniform. They vary. They vary according to the extent to which the constituent units are permitted to pursue different regulatory policies. They vary according to the scope of lawmaking competence and powers allocated to the central authority. They vary too according to the governing institutional (judicial and political) arrangements. The quality and intensity of the regulated environment varies according to the choices made. There is a broad band of possible internal markets, ranging from one which is radically decentralized as a result of a choice in favour of unrestricted inter-jurisdictional competition to, at the other extreme, one which is radically centralized in the sense that lawmaking competence has been completely stripped away from the constituent units in favour of the central authority. Within that spectrum there is a huge range of options. This book examines and explains the choices made by the EU, and shows what they entail for the shape of the EU’s internal market.
