This book is unique in presenting an interdisciplinary conversation between jurists and logicians. It brings together scholars from both law and philosophy and looks at the application of 'the new logics' to law and legal ordering, in a number of legal systems. The first Part explores the ways in which the new logics shed light on the functioning of legal orders, including the structure of legal argumentation and the rules of evidence. The second addresses how non-classical logics can help us to understand the interactions between multiple legal orders, in a range of contexts including domestic and international law. The final Part examines particular issues in the applicability of non-classical logics to legal reasoning. This book will be of interest to jurisprudence and logic scholars and students who want to deepen their understanding of relationships between law and legal reasoning, and learn about recent developments in formal logic.

Il s'agit en substance d'analyser comment l'écriture nécessaire à la description du droit positif déforme celui-ci. Dans cet ouvrage, il est soutenu plus techniquement que la production, par l'ensemble des juristes, des textes décrivant le droit constitue un phénomène juridique irréductible aux notions de "coutume", "doctrine", "jurisprudence" ou aux théories de l'"interprétation". C'est ce phénomène (supposant d'écrire afin de décrire le droit), ainsi que la théorie que les auteurs en proposent, que ces derniers nomment la décriture du droit en forgeant un néologisme. Les auteurs ont éprouvé leur hypothèse et leur méthode de travail à plusieurs reprises, depuis 2013, au cours de conférences et de présentations à des colloques, notamment en France, au Canada et au Brésil. This book uses role theory to analyze the judicial decisions made by state supreme court judges. Grounded in the fields of anthropology, business management, psychology, and sociology, role theory holds that, for each position an individual occupies in society, he or she creates a role orientation, or a belief about the limits of proper behavior. Judicial role orientation is conceptualized as the stimuli that a judge feels can legitimately be allowed to influence his or her decision-making and, in the case of conflict among influences, what priorities to assign to different decisional criteria. This role orientation is generally seen as existing on a spectrum ranging from activist to restraintist. Using multi-faceted data collection and empirical testing, this book discusses the variation in judges’ role orientations, the role that personal institutional structure and judges' backgrounds play in determining judicial orientations, and the degree to which judges’ orientations affect their decision-making. The first study to provide cross-institutional research on state supreme court judges, this book expands and advances the literature on judicial role orientation. As such, this book will be of interest to graduate students and researchers studying political science, public policy, law, and the courts. .
