Abstract

Selon quels critères peut-on analyser les différentes traditions juridiques mondiales ? Comment le rapprochement et l'unification de ces traditions s'effectuent-ils ? Quels sont les nouveaux paradigmes de comparaison à l'heure de la mondialisation du droit ? Le droit comparé est une science qui étudie et confronte les différents systèmes juridiques du monde. Abordée pour la première fois au XVIIIe siècle par Montesquieu, cette discipline est en constante évolution. Les grandes traditions juridiques mondiales ne cessent en effet d'échanger et de transmettre, et témoignent d'une vitalité et d'une ouverture palpables. En se fondant sur trois critères : le caractère laïcisé ou non de la tradition juridique, le rapport que le juge entretient avec la règle écrite et la conception sociale de la règle de droit au sein de l'État, cet ouvrage établit une typologie des traditions juridiques mondiales. Il permet de saisir les enjeux théoriques fondamentaux et les questions pratiques qui en découlent, en rappelant que le droit reste fondamentalement un fait social et culturel qui s'inscrit dans des traditions bien réelles.

In a context that may seem, to a fairly realistic pessimist, of forced choice between fanatic neo-fundamentalisms and trivializing single thought, a 'common cause' like the Italian Constitution offers itself as a reference to which to look at with motivated trust from different perspectives and situations, often conflicting. To constitutionalize means to make the Constitution more authentically itself by preserving what is to be guarded and creating what is yet to be created. The underlying theme and highly original contribution of this book is the concept of pléroma or fullness of being: a strategic concept that enhances the original personalism of the Constitution and absorbs - by unifying and orienting - the restoring, interpreting and integrating of the constitutional text, proposing a political-legal project in line with the current times.

Abstract

Governing the complexity of contemporary multicultural societies poses major challenges and a constant tension between substantial equality, the right to difference and social order. Tools, paths and strategies to integrate different communities and individuals within the same horizon of rights and duties are essential to give life to new types of citizenship and to a new sense of belonging. The volume aims to open a critical reflection on the subject, allowing to combine the theoretical horizon with the effectiveness of the law, by analysing four relevant experiences in the European panorama: United Kingdom, France, Germany and Italy. These are experiences that propose different models and mechanisms of integration, but which are all crossed by the need to research and experiment innovative and effective paths to cope with one of the most delicate challenges of our time.

Abstract

The article adresses the well-known question about the eventual links between the Old Russian Domostroi and the European domestic handbooks and focuses on the aporia to which lead all the previous comparative works. The methodological character of the impasse apears clearly when we analyze those works in the light of a clearly defined comparative method. As a result, the author suggests to address the relationships between the Domostroi and its European analogues no more from the traditional literary point of view but from a historical one.
