Mit den gebiets- und artenschutzrechtlichen Regelungen der FFH- und Vogelschutzrichtlinie bestehen Vorgaben, die den vorhabenbedingten Beeinträchtigungen von Lebensräumen und Arten entgegenwirken sollen. Planerische Vorgaben sowie konkrete Anforderungen an die Durchführung des FFH-Abweichungsverfahrens sowie des artenschutzrechtlichen Ausnahmeverfahrens sind bislang nicht hinreichend geklärt. Um zu einer Klärung zu gelangen, analysiert die Arbeit zunächst vorliegende Rechtsprechung, Leitfäden, Literatur sowie ausgewählter Fallbeispiele. Ergänzend werden Experteninterviews sowie eine Befragung von Experten in vier EU-Mitgliedstaaten durchgeführt, um Widersprüche, bestehende Schwierigkeiten und offene Fragen aufzuzeigen. Durch eine kritische Reflexion der Analyseergebnisse werden beste.

Het omgevingsrecht regelt de ordening en de bescherming van onze leefomgeving. Het gaat dan om het milieurecht, het natuurbeschermingsrecht, het ruimtelijk bestuursrecht, het waterrecht en de samenhang daartussen. Dit boek bevat de hoofdlijnen van het omgevingsrecht. Stapsgewijs wordt de lezer door het omgevingsrecht geleid, waarbij de doorwerking van het Europese omgevingsrecht op structurele wijze bij de verschillende onderwerpen wordt meegenomen. Vanzelfsprekend is er ook aandacht voor de handhaving van het omgevingsrecht en de rechtsbescherming tegen omgevingsrechtelijke besluiten. Deze druk is geheel geactualiseerd en aangepast aan recente ontwikkelingen in wetgeving, jurisprudentie en praktijk. Daarbij zijn onder meer de inwerkingtreding van de Wet natuurbescherming en de implementatie van de wijzigingsrichtlijn milieueffectrapportage meegenomen. Ook wordt ruim aandacht besteed aan het instrumentarium van de toekomstige Omgevingswet. Dit boek is primair bedoeld voor studenten op gevorderd bachelor- en masterniveau, maar kan zeker ook van nut zijn voor de rechtspraktijk. De auteurs Mr. dr. M.N. Europe still retains large areas which play host to numerous native and free-functioning ecosystems and lack roads, buildings, bridges, cables and other permanent manifestations of modern society. In the past such areas were considered wastelands, whose value lay only in their potential for cultivation and economic exploitation. Today, these wilderness areas are increasingly cherished as places for rest and recreation and as important areas for scientific research, biodiversity conservation and the mitigation of and adaptation to certain climate change effects.
