Mit den gebiets- und artenschutzrechtlichen Regelungen der FFH- und Vogelschutzrichtlinie bestehen Vorgaben, die den vorhabenbedingten Beeinträchtigungen von Lebensräumen und Arten entgegenwirken sollen. Planerische Vorgaben sowie konkrete Anforderungen an die Durchführung des FFH-Abweichungsverfahrens sowie des artenschutzrechtlichen Ausnahmeverfahrens sind bislang nicht hinreichend geklärt. Um zu einer Klärung zu gelangen, analysiert die Arbeit zunächst vorliegende Rechtsprechung, Leitfäden, Literatur sowie ausgewählter Fallbeispiele. Ergänzend werden Experteninterviews sowie eine Befragung von Experten in vier EU-Mitgliedstaaten durchgeführt, um Widersprüche, bestehende Schwierigkeiten und offene Fragen aufzuzeigen. Durch eine kritische Reflexion der Analyseergebnisse werden beste.
