"Karen Tracy examines the identity-work of judges and attorneys in state supreme courts as they debated the legality of existing marriage laws. Exchanges in state appellate courts are juxtaposed with the talk that occurred between citizens and elected officials in legislative hearings considering whether to revise state marriage laws. The book's analysis spans ten years, beginning with the U.S. Supreme Court's overturning of sodomy laws in 2003 and ending in 2013 when the U.S. Supreme Court declared the federal government's Defense of Marriage Act (DOMA) unconstitutional, and it particularly focuses on how social change was accomplished through and reflected in these law-making and law-interpreting discourses. ... Abstract

Xiaoping Cong examines the social and cultural significance of Chinese revolutionary legal practice in the construction of marriage and gender relations. Her book is an empirically rich investigation of the ways in which a 1943 legal dispute over an arranged marriage in a Chinese village became a legal, political and cultural exemplar on the national stage. This conceptually groundbreaking study revisits the Chinese Revolution and its impact on women and society by presenting a Chinese experience that cannot and should not be theorized in the framework of Western discourse. Taking a cultural historical perspective, Cong shows how the Chinese Revolution and its legal practices produced new discourses, neologisms and cultural symbols that contained China's experience in twentieth-century social movements, and how revolutionary practice was sublimated into the concept of 'self-determination', an idea that bridged local experiences with the tendency of the twentieth-century world, and that is a revolutionary legacy for China today.

Abstract

Marriage is ordinarily a public practice, supported by, as well as supportive of, society. But it need not fall within the purview of the state. Public Practice, Private Law articulates a conception of marriage as a morally rich and important institution that ought to be subject to private rather than legislative or judicial ordering. It elaborates a robust understanding of marriage that captures what both different-sex and same-sex couples might see as valuable about their relationships. It explains why sexual ethics won't yield a normative model of marriage, and why the kind of marital love worth wanting, can. It goes on to show how an understanding of marriage as rooted in demanding commitments can allow for divorce before arguing that the state should cease to sponsor marriages. It concludes by suggesting that both state and non-state institutions should acknowledge the marriages of same-sex couples.
