Abstract

Many of the defining features of the modern law of tort can be traced to the first half of the twentieth century, but, until now, developments in that period have never received a dedicated historical examination. This book examines both common law and statutory innovations, paying special attention to underlying assumptions about the operation of society, the function of tort law, and the roles of those involved in legal changes. It recovers the legal and social contexts in which some landmark decisions were given (and which puts those decisions in a very different light) and draws attention to significant and suggestive cases that have fallen into neglect. It also explores the theoretical debates of the period about the nature of tort law, and reveals the fascinating patterns of influence and power at work behind statutory initiatives to reform the law.

Abstract

"The starting point for this project on the "Basic Questions of Tort Law" was the book written by Helmut Koziol, the "Basic Questions of Tort Law from a Germanic Perspective" (Sramek Verlag, 2012), a volume which presented an introduction into the law of torts from a Germanic perspective. Colleagues from seven countries were then invited to give critical responses to the ideas presented in the 2012 volume. The comparative law conclusions then attempt to pick up on the ideas expressed in the legal systems examined and to make them amenable for debate on the further development of the legal systems and their harmonisation. Obviously, it was not possible to respond to all of the valuable thoughts contained in the country reports. Above all, the focus was on ideas that have not yet been discussed very often and also on providing impulses in relation to legal policies. It was fascinating that often the national responses to law of damages issues at first gave the impression of being less than appropriate but then in relation to basic ideas within the respective legal systems and in interplay with other legal institutions, for example social security law, they turned out to have good arguments in their favour. Moreover, there were sometimes additional features in yet other legal systems that supplied ideas for how to further develop a not-yet persuasive solution and which ultimately led to surprising, new basic concepts, which could deliver valuable ideas for the development and harmonisation of the European law of damages. Thus, it was possible to develop in the area of personal injuries a proposal for a new kind of interplay between the law of damages, liability insurance, and social security, which could offer many benefits." -- Publisher's website.

Abstract

The fields of tort and crime have much in common in practice, particularly in how they both try to respond to wrongs and regulate future behaviour. Despite this commonality in fact, fascinating difficulties have hitherto not been resolved about how legal systems co-ordinate (or leave wild) the border between tort and crime. What is the purpose of tort law and criminal law, and how do you tell the difference between them? Do criminal lawyers and civil lawyers reason and argue in the same way? Are the rules on capacity, consent, fault, causation, secondary liability or defences the same in tort as in crime? How do the rules of procedure operate for each area? Are there points of overlap? When, how and why do tort and crime interact? This volume systematically answers these and other questions for eight legal systems: England, France, Germany, Sweden, Spain, Scotland, the Netherlands and Australia.

Abstract

'Murder Capital' is a historical study of suspicious deaths, unexpected deaths whose circumstances required official investigation, in mid-twentieth-century London. Suspicious deaths - murders in the family and by strangers, infanticides and deaths from illegal abortions - reveal moments of personal and communal crisis in the social fabric of the city. By setting the institutional ordering of the city against the hidden intimate spaces where crimes occurred and were discovered, the book presents a new popular history of the city.
