Die kulturwissenschaftlichen Perspektiven auf das Recht sind vielfältig. Der Band geht vor allem den normativen Verwendungsweisen des ‚Kultur‘-Begriffs in der Rechtswissenschaft nach – von der neukantianischen Kulturphilosophie bis zum Poststrukturalismus, bei kommunitaristischen und multikulturalistischen Autoren, in der ‚kulturwissenschaftlichen Verfassungslehre‘ sowie in jenen Ansätzen, denen zufolge das Grundgesetz von einer ‚christlichen Kultur‘ überformt wird. Seine Antwort auf die Frage, was der Begriff der Kultur zur Eigenreflexion des Rechts beitragen kann, lautet: Nichts, außer Verwirrung. Die These von der Kultur als einer Geltungsquelle von Recht ist falsch. Es führt kein Weg von der Kultur zum Rechtssystem oder von kulturellen Werten zum Gehalt juridischer Normen. Der Kulturbegriff kann deshalb am Ende wenig anderes leisten, als die Anforderungen zu unterlaufen, denen rechtliches Begründen genügen muss. Der Autor lehrt Rechtsphilosophie an der Westfälischen Wilhelms-Universität Münster und forscht im dortigen Exzellenzcluster „Religion und Politik“.

This book aims to create an interface between intellectual property and diversity - including cultural, biological, religious, racial, and gender-based diversity. While acknowledging that the historical rationale for intellectual property protection is based on theories of utilitarian incentives and property rights, the authors of this volume assert that the current intellectual property framework is not incompatible with including diversity as part of its objectives. Through its various themes, this book delves into the debate of whether such inclusion can be made possible and how intellectual property norms could be effectively used to protect and promote diversity. In this volume, leading scholars address ongoing regional, national, and international debates within the contexts of diversity, the existing legal framework, and the broader political and economic climate. The authors tackle such wide-ranging topics as the prohibition against trademarking slurs and concepts of intellectual property in ancient Indian texts.

Ende des 16. Jahrhunderts ist in ganz Europa eine gewaltige Bildproduktion des christlichen Martyriums zu verzeichnen. Im Umkreis des Jesuitengenerals Claudio Acquaviva werden Kirchen und Kollegien mit grausamen Opfertoden ausgekleidet, die dann über Druckwerke weltweite Verbreitung finden. Jene Bilder, die das Gesetz, die Entscheidung und die Handlungen tyrannischer Regime als Folterqualen der Märtyrer visualisieren, warnen vor einer Bedrohung der eigenen Rechtsordnung. Die binäre Opposition von Gut und Böse ist nicht allein konfessionell oder politisch zu deuten, sondern als Verhandlung moralisch-juridischer Prinzipien. Die Bilder von Märtyrern und Tyrannen werden somit erstmals sowohl als Figuren der Theologie als auch des zeitgenössischen Rechtsgedankens evident. Throughout Europe, the end of the 16th century saw an enormous output of images of Christian martyrdom. Images portraying the law and the behavior of tyrannical regimes in terms of the torment of the martyrs signaled the threats to their own legal system. For the first time, the images of martyrs and tyrants are presented as both religious figures and reflections of contemporary thinking about the law.
