Abstract

La loi n°2014-344 du 17 mars 2014 relative à la consommation, dite loi " Hamon ", a introduit l'action de groupe en droit français. Cette nouvelle procédure, longtemps espérée par certains ou redoutée par d'autres, offre une voie de recours collectif d'une grande originalité aux litiges de consommation de masse. Notre droit rejoint ainsi les nombreux systèmes juridiques qui, sous des appellations et des formes variées, et pour certains, depuis des décennies, connaissent l'action de groupe. Comment la " class action " à la française se situe-t-elle dans la diversité des expériences étrangères ? Quel premier bilan peut-on esquisser après quelques mois de pratique de cette nouvelle procédure ? Quelles perspectives d'extension de l'action de groupe à d'autres domaines que celui de la consommation sont-elles prévisibles, voire souhaitables ? De telles questions, aux enjeux considérables, tant aux plans judiciaire qu'économique, ont été soumises à un panel d'universitaires, de magistrats, d'avocats et de représentants du monde de l'entreprise lors d'un colloque que le Centre français de droit comparé a organisé à Paris le jeudi 26 mars 2015.
