"The Federal Aviation Administration (FAA) is currently undertaking a broad program known as Next Generation Air Transportation System (NextGen) to develop, introduce, and certify new technologies into the National Airspace System. NextGen is a fundamentally transformative change that is being implemented incrementally over a period of many years. Currently, the FAA is putting into place the foundation that provides support for the future building blocks of a fully operational NextGen. NextGen is a challenging undertaking that includes ground systems, avionics installed in a wide range of aircraft, and procedures to take advantage of the new technology. Transformation in the Air assesses the FAA's plan for research on methods and procedures to improve both confidence in and the timeliness of certification of new technologies for their introduction into the National Airspace System. This report makes recommendations to include both ground and air elements and document the plan's relationship to the other activities and procedures required for certification and implementation into the National Airspace System."-- Publisher description.

Abstract

The study examines actual entry and exit dynamics in the German airline market in light of the European liberalization process. For this purpose, flight schedules data was used to derive entry and exit statistics for a set of chosen inner-German routes over a period of thirteen years. Data was analysed in cross-sectional and longitudinal manner while identifying different entry waves and examining incumbent behaviour with respect to entry deterrence strategies. Furthermore, the market's concentration and structure was tracked to allow a conclusion with respect to the market's contestability after liberalization. The results suggest the existence of remaining structural barriers to entry and depict a rather unsatisfactory overall state of the post liberalized market.

La comparaison du Lockheed Constellation de la KLM desservant l’aéroport d’Amsterdam Schiphol dans les années 1950 et de l’actuel Boeing Dreamliner résume bien les mutations profondes du transport aérien de passagers : sa massification avec l’essor des capacités des aéronefs, sa mondialisation avec l’essor des rayons d’action et sa technicisation avec les commandes assistées, le guidage et le contrôle aérien. L’entrée en vigueur de la Convention de Montréal, qui vient moderniser l’ancienne Convention de Varsovie, reflète ce processus. Parallèlement, l’essor du droit dérivé de l’Union européenne et l’humanisation du droit international conduisent à considérer toujours plus les droits du passager, qu’il s’agisse de droits subjectifs ou de droits fondamentaux. L’actualité rappelle cependant, hélas, que le transport aérien de passagers n’est jamais prémuni des soubresauts de l’actualité géopolitique internationale ou des conséquences de la libéralisation des marchés. En matière aérienne, aux fins de la détermination concrète des droits des passagers et des compagnies, le jurisconsulte est confronté au défi de l’articulation des ordres juridiques : ordre juridique international, ordre juridique intégré de l’Union européenne ou des organisations régionales d’intégration économique, ordres juridiques nationaux…
