L'histoire du droit de la santé est une discipline jeune. En effet, les juristes-historiens des facultés de droit sont longtemps restés complètement absents des deux champs immenses de l'histoire sanitaire d'une part et du droit de la santé d'autre part. Pourtant le regretté Jean Imbert (1919-1999) avait magistralement ouvert la voie, avec ses célèbres travaux d'histoire du droit hospitalier, qui font toujours autorité. La situation a changé dans les années 2000 avec une floraison d'excellents travaux à Paris, Aix-en-Provence, Strasbourg... Cet ouvrage est la première synthèse sur le sujet. Il est sans équivalent en langue française. Le sens de l'évolution générale retracée est assez clair : traditionnellement affaire privée (sauf survenance d'épidémies impliquant les pouvoirs publics), la santé est devenue une affaire d'État, depuis les XVIIIe-XIXe siècles, ce qui a donné naissance en France à un système caractérisé par l'interventionnisme étatique et un monopole strict, à l'ombre desquels a prospéré un exercice « libéral ». Ce « modèle français » qui s'est épanoui au XXe siècle est désormais profondément remis en question dans un environnement qui n'est plus celui de l'histoire mais du « droit positif » marqué par la prévalence du droit européen et de la libéralisation économique.

A prolific artist who synthesized formal problems through a close study of objects, Cézanne's lifelong engagement with still life painting yielded what is arguably the single most innovative body of work in the genre of any artist in the Western canon.
