Rédigé à Narbonne vers 1293-1295, le Traité des contrats du grand théologien franciscain Pierre de Jean Olivi est le pionnier d'un genre appelé à un large développement. Tirant les conséquences de règles et de notions élaborées par les traditions juridiques, théologiques et philosophiques du treizième siècle, Olivi aborde le champ des relations économiques dans sa globalité, du point de vue d'une théologie morale attentive à la liberté des acteurs et respectueuse de la capacité normative des communautés politiques. Par la vigueur et l'acuité de ses analyses, l'ouvrage mérite d'être considéré comme un moment d'origine de l'histoire de la pensée économique occidentale. Ses réflexions sur les déterminants de la valeur des biens et services ou sur le profit futur d'un "capital" investi dans des opérations commerciales ont fourni la trame des discussions ultérieures. Découvert dans les années 1970, le texte d'Olivi avait suscité des réactions contrastées. Cette nouvelle édition critique, mettant à profit des témoins supplémentaires, résout les principales difficultés qui entravaient la compréhension du Traité. La présentation et les commentaires, qui visent à situer l'ouvrage dans ses différents contextes d'interprétation, permettent d'expliquer un paradoxe apparent: l'un des partisans les plus décidés de la pauvreté franciscaine a en même temps été le penseur le plus perspicace de l'économie médiévale.

The essays in this volume in honour of Paul Brand, Senior Research Fellow of All Souls College, Oxford, match his career and interests in the world of legal history as well as medieval social and economic history and textual studies. The topics explored include the Angevin reforms, legal literature, the legal profession and judiciary, land law, the relation between the crown and the Jews, the interaction of the Common Law with Canon and Civil Law, as well as procedural and testamentary procedures, the management of both ecclesiastical and lay estates and the afterlife of medieval learning. Like Brand’s own work, all the essays are grounded on detailed studies of primary sources. The prize, which is awarded annually, is for the best article on English legal history published in the previous year.
