Un droit n’est rien sans la preuve de l’acte ou du fait dont il dérive. La matière de la preuve s’insère dans tous les domaines du droit et s’est développée de telle façon qu’est aujourd’hui reconnu un ‘droit à la preuve’. Cette quatrième édition tient compte des différentes modifications législatives, notamment la loi du 11 mars 2003 sur certains aspects juridiques des services de la société de l’information, la loi du 10 décembre 2009 sur les services de paiement et la loi du 6 avril 2010 relative aux pratiques du marché et à la protection du consommateur. L’évolution se marque également dans la jurisprudence, avec d’importants arrêts de cassation en matière d’aveu et d’utilisation de preuves illégales. Au-delà de ces arrêts marquants, cette mise à jour reprend plus de 300 références nouvelles de jurisprudence. Le droit de la preuve est de plus en plus tributaire, dans certains de ses aspects, du droit au respect de la vie privée, avec lequel il entre en conflit. Plusieurs parties du traité ont donc été réécrites pour tenir compte de l’impact de l’article 8 de la Convention européenne des droits de l’homme et de la loi du 8 décembre 1992 relative à la protection de la vie privée à l'égard des traitements de données à caractère personnel. La chapitre relatif aux problèmes de preuve posés par l’utilisation d’internet et du courrier électronique a été remanié pour tenir compte de l’évolution tant technique que juridique dans cette matière. In The Shadow of the Past, Gregory D. Miller examines the role that reputation plays in international politics, emphasizing the importance of reliability-confidence that, based on past political actions, a country will make good on its promises-in the formation of military alliances. Challenging recent scholarship that focuses on the importance of credibility-a state's reputation for following through on its threats-Miller finds that reliable states have much greater freedom in forming alliances than those that invest resources in building military force but then use it inconsistently.To explore the formation and maintenance of alliances based on reputation, Miller draws on insights from both political science and business theory to track the evolution of great power relations before the First World War. He starts with the British decision to abandon "splendid isolation" in 1900 and examines three crises-the First Moroccan Crisis (1905-6), the Bosnia-Herzegovina Crisis (1908-9), and the Agadir Crisis (1911)-leading up to the war. He determines that states with a reputation for being a reliable ally have an easier time finding other reliable allies, and have greater autonomy within their alliances, than do states with a reputation for unreliability. Further, a history of reliability carries long-term benefits, as states tend not to lose allies even when their reputation declines.
