Abstract

Het moeten zoeken naar antwoorden op juridische vragen met betrekking tot  auteursrechtelijk beschermde werken, merken, modellen, octrooien en andere beschermde creaties van de geest is al lang niet meer voorbehouden aan een kleine groep van specialisten. Bijna iedere jurist wordt vandaag de dag wel eens geconfronteerd met vragen ivm intellectuel eigendom: bijvoorbeeld of  een bepaald teken al dan niet een  inbreuk maakt op een beschermd merk,  of de creatie van zijn cliënt of werkgever auteursrechtelijk dan wel octrooirechtelijk beschermd kan worden, enz.Het wetboek wil aan iedereen die geconfronteerd wordt met problemen inzake het recht van de intellectuele eigendom,  de toepasselijke wetgeving aanbieden en de toe te passen regels toelichten, om het probleem dat zich stelt snel en correct te kunnen oplossen, minstens zich een eerste idee te vormen en richting te geven aan het vinden van een oplossing. Het boek brengt daartoe de belangrijkste wetgeving inzake het recht van de intellectuele eigendom bijeen en voorziet de voornaamste artikelen ervan van een commentaar. Niet alleen Belgische wetteksten, maar ook internationale verdragen, evenals Europese verordeningen en richtlijnen werden verzameld en  thematisch geordend.  Na het Unieverdrag van Parijs dat betrekking heeft op de industriële eigendom, werden de teksten inzake het auteursrecht (met inbegrip van software en databanken), het modellenrecht, het merken- en octrooirecht en het kwekersrecht opgenomen. Achteraan in het wetboek kunnen de toepasselijke regels inzake sancties en procedures worden teruggevonden.

Abstract

"Matching grants are one of the most common policy instruments used by developing country governments to try to foster technological upgrading, innovation, exports, use of business development services and other activities leading to firm growth. However, since they involve subsidizing firms, the risk is that they could crowd out private investment, subsidizing activities that firms were planning to undertake anyway, or lead to pure private gains, rather than generating the public gains that justify government intervention. As a result, rigorous evaluation of the effects of such programs is important. The authors attempted to implement randomized experiments to evaluate the impact of seven matching grant programs offered in six African countries, but in each case were unable to complete an experimental evaluation. One critique of randomized experiments is publication bias, whereby only those experiments with "interesting" results get published. The hope is to mitigate this bias by learning from the experiments that never happened. This paper describes the three main proximate reasons for lack of implementation: continued project delays, politicians not willing to allow random assignment, and low program take-up; and then delves into the underlying causes of these occurring. Political economy, overly stringent eligibility criteria that do not take account of where value-added may be highest, a lack of attention to detail in "last mile" issues, incentives facing project implementation staff, and the way impact evaluations are funded, and all help explain the failure of randomization. Lessons are drawn from these experiences for both the implementation and the possible evaluation of future projects"--Abstract.

Abstract

Nombre d'études sur la diversification des exportations sujet sont essentiellement consacrées aux pays industrialisés ou émergents, un fait regrettable compte tenu de la vulnérabilité à laquelle les forts degrés de concentration des exportations exposent les pays les plus pauvres. Cet article se concentre donc sur les pays de la zone franc, un contexte rarement étudié jusque lors, et qui révèle combien les bases exportatrices des pays, même les plus pauvres, se renouvellent et s'enrichissent parfois de nouveaux biens. Après une revue rapide des évolutions récentes de la littérature sur le sujet, la deuxième partie de cet article propose trois indicateurs de diversification des exportations. La troisième partie est consacrée au choix et au traitement des données, qui se révèlent particulièrement délicats en zone franc. Enfin, la quatrième partie est consacrée à la présentation des résultats de cette étude.

While good governance is a worthy goal, this book argues that it is not a prerequisite for economic growth or development. The book exposes the methodological shortcomings of the commonly-used governance indicators developed within the World Bank. The authors argue that donors should not impose onerous good governance conditions, expecting the developing world to simulate now-developed countries. They contend that most poor countries lack the administrative and financial capacity to achieve these reforms or institutions - so donor conditionality often becomes a recipe for failure.In place of grand government reforms aimed at enhancing market efficiency, the book's position is that the reform agenda should target strategic bottlenecks for development and enhance the state's capacity to deal with these disruptions. Bringing together contributions from leading political scientists, political economists and development practitioners, this is the first book to provide a systematic critical perspective on received notions of good governance.
