This study analyzes the specific textual formation of Mishna Sotah. Diverging significantly from its origins in the book of Numbers, the Mishnaic ritual was traditionally read by scholars as an 'ancient Mishna', narrating an actual ritual practiced in the second temple. In contrast to this generally accepted view, this book claims that while Sotah does contain some traditions, its overall composition has a clear ideological and academic form. Furthermore, comparisons with parallel Tannaitic sources reveal the ideological redaction, which carefully selected only those opinions which support its rewriting of the ritual as a public punitive ritual, while rejecting all reservations and opposition to its specific punitive character – even ignoring the possibility of innocence of the suspected adulteress. The author’s groundbreaking conclusion is that, regardless of the form the real ritual did or did not take at the temple, the specific Mishnaic ritual was (re)invented by the rabbis in the second century C.E. From its very inception, it was purely textual, reflecting rabbinic imagination rather than memory.

Les couples sont donc aujourd'hui juridiquement pluriels, et ils sont désormais libres, hors de toute contrainte juridique ou sociale, de choisir le statut qui leur paraîtra le mieux répondre à leurs convictions ou sentiments personnels ou à leur analyse économique des coûts/bénéfices respectifs de chacun de ces statuts. Les membres des Centres de droit de la famille des Universités de Louvain et de Bordeaux IV ont souhaité procédé, en deux temps, à une analyse approfondie de ces évolutions en droit belge et en droit français. Dans ce premier volume, il s'agit - et il s'agit seulement - de relever de manière systématique, dans chacun des deux systèmes juridiques, les différences autant que les rapprochements qu'il convient d'opérer entre les statuts juridiques du mariage, de la cohabitation légale ou du Pacs et de la cohabitation de fait ou du concubinage. Un second volume, fruit d'un travail de recherche commun, s'attachera à étudier les conséquences qui peuvent résulter de l'importance désormais conférée à la liberté des hommes et des femmes, c'est-à-dire, en termes juridiques, à l'autonomie de leurs volontés individuelles lors de l'élaboration du statut juridique de leur couple : que signifie dès lors précisément, sur les plans autant théorique que pratique, la "conventionnalisation" du lien de couple ?
