Abstract

Courts of law at once reflect and shape the society in which they reside and dispense justice. To mark the 2010 centenary of BC's highest court � the British Columbia Court of Appeal � this book presents an institutional, jurisprudential, and biographical account of the court and its evolving role in the province. Richly illustrated and replete with biographical sketches, group portraits of judges, and careful explorations of significant and representative cases, this authoritative history explores how the court came into being, how it has operated, and who its judges have been. In the process, it tells the story of how the court has shaped � and been shaped by � the social, political, and legal development of British Columbia. This much-needed addition to the judicial history of Canada raises questions for British Columbia legal historians to pursue and for scholars, judges, lawyers, and Canadians in general to ponder.

Abstract

An associate justice on the renowned Warren Court whose landmark ruling in Brown v. Board of Education overturned racial segregation in schools and other public facilities, Tom C. Clark was a crusader for justice throughout his long legal career. Among many tributes Clark received, Supreme Court Chief Justice Warren Burger opined that "no man in the past thirty years has contributed more to the improvement of justice than Tom Clark." Supreme Court Justice Tom C. Clark is the first biography of this important American jurist. Written by his daughter, Mimi Clark Gronlund, and based on interviews with many of Clark's judicial associates, friends, and family, as well as archival research, it offers a well-rounded portrait of a lawyer and judge who dealt with issues that remain in contention today—civil rights, the rights of the accused, school prayer, and censorship/pornography, among them. Gronlund explores the factors in her father's upbringing and education that helped form his judicial philosophy, then describes how that philosophy shaped his decisions on key issues and cases, including the internment of Japanese Americans during World War II, the investigation of war fraud, the Truman administration's loyalty program (an anti-communist effort), the Brown decision, Mapp v. Ohio (protections against unreasonable search and seizure), and Abington v. Schempp (which overturned a state law that required reading from the Bible each day in public schools).

Contrairement aux idées reçues, l'étude des doctrines des magistrats de la fin de l'Ancien Régime révèle une réflexion cohérente de la grande robe française sur la question des institutions libérales. Au sein du complexe des pensées libérales, ces doctrines se singularisent par leur attachement à une forme de libéralisme institutionnel et non individualiste dont le propos, à rebours des courants libéraux majoritaires, n'est pas l'élaboration d'une théorie politique fondée sur l'autonomie du sujet ou la définition des conditions d'émancipation de l'individu. L'étude de sources diverses (remontrances principalement, mais aussi écrits personnels des magistrats ou des tenants des idées parlementaires) dévoile, avec les méthodes singulières des grands robins — héritiers, sur ce point, de la tradition humaniste —, leur culture juridique, leurs valeurs, leur savoir du politique, mais aussi leur attachement réel à la liberté et leur effort sans cesse renouvelé pour penser les conditions de l'existence de l'État modéré. À cet égard, il apparaît très vite que l'effectivité de la liberté telle qu'ils la conçoivent dépend de l'existence d'une diversité, à la fois institutionnelle et sociale, qui est, pour partie, pensée en termes d'inégalité. Mais si elles semblent, dans leurs écrits, assez largement liées aux structures et aux hiérarchies de la société française d'avant 1789, la liberté et les institutions libérales telles que les grands robins les pensent ne sont pas exclusivement réalisables dans le cadre du modèle aristocratique: les socles sur lesquels peut venir s'enraciner le jeu institutionnel à partir duquel se déploiera l'équilibre libéral sont multiples. C'est là que réside la grande leçon du libéralisme institutionnel. Car ce qui importe n'est pas tant que les magistrats de l'ancienne France aient cru que la liberté ne pouvait exister sans noblesse ni Parlements, mais qu'ils aient vu que l'épanouissement de la liberté était tributaire d'un pluralisme de vues exprimées par des institutions ordonnées de façon à prévenir la domination exclusive et durable de l'une d'entre elles. On ne saurait d'ailleurs exclure que les plus éclairés de ces hommes aient pu entrevoir un système de libéralisme des intérêts à la façon des pères fondateurs de la Constitution américaine, qui étaient leurs contemporains. Des éléments de continuité doctrinale permettent enfin de penser que les traditions libérales françaises du premier XIXe siècle — au premier rang desquelles la tradition doctrinaire — ont, dans une certaine mesure, une dette à l'égard du monde de la robe ancienne : les doctrines parlementaires des Lumières constituent sans doute un moment dans l'histoire du libéralisme à la française, une étape dans l'élaboration historique d'un autre libéralisme.
