Abstract

"The use of private property rights to regulate natural resources is a controversial topic because it touches upon two critical issues: the allocation of wealth in society and the conservation and management of limited resources. This book explores the extension of private property rights and market mechanisms to natural resources in international areas from a legal perspective. It uses marine fisheries to illustrate the issues that can arise in the design of regulatory regimes for natural resources. If property rights are used to regulate natural resources then it is essential that we understand how the law and values embedded within legal systems shape the development and operation of property rights in practice. The author constructs a version of property that articulates both the private and public function of property. This restores some much needed balance to property discourse. He also assesses the impact of international law on the use of property rights-a much neglected topic-and shows how different legal and socio-political values that inhere in different legal regimes fundamentally shape the construction of property rights. Despite the many claimed benefits to be had from the use of private property rights-based management systems, the author warns against an uncritical acceptance of this approach and, in particular, questions whether private property rights are the most suitable and effective arrangement of regulating of natural resources. He suggests that much more complex forms of holding, such as stewardship, may be required to meet physical, legal and moral imperatives associated with natural resources."--Bloomsbury Publishing.

Abstract

This work investigates the permissibility and viability of property rights on the celestial bodies, particularly the extraterrestrial aspects of land and mineral resources ownership. In lay terms, it aims to find an answer to the question "Who owns the Moon?" After critically analyzing and dismantling with legal arguments the trivial issue of sale of extraterrestrial real estate, the book addresses the apparent silence of the law in the field of landed property in outer space, scrutinizing whether the factual situation on the extraterrestrial realms calls for legal regulations. The legal status of asteroids and the relationship between appropriation under international law and civil law appropriation are duly examined, as well as different property patterns – such as the commons regime, the Common Heritage of the Mankind, and the Frontier paradigm. Virgiliu Pop is one of world's specialists in the area of space property rights. A member of the International Institute of Space Law, Virgiliu has authored several acclaimed papers in the field of space law and policy, and was interviewed by prestigious media outlets as diverse as New Scientist, Space.com/MSNBC, The Space Show, La Tercera (Chile), Ta Nea (Greece), Geo Magazine (Germany) and several publications in his native Romania.

Abstract

As the use of human body parts has become increasingly commercialized, a need has arisen for new approaches to regulation that move beyond the paradigm of altruism. In the course of this discussion, the notion of property has become a key concept. This volume focuses on practical and conceptual perspectives to set standards for a detailed and innovative discussion in the regulation of research on human tissue. The authors, a multidisciplinary research group combining specialists from philosophy, law, sociology, biology and medicine have come together with practicing lawyers to consider both legal provisions and patterns of regulation in countries across Europe. The authors identify divergences between the different legal traditions, and explore various conceptual models which could be used to improve and to guide policy making. With this twin focus on practical and conceptual perspectives the volume sets standards for a detailed and innovative discussion of problems in the regulation of research on human tissue.
