Written by the eminent German legal historian, Michael Stolleis, these two 'Essays on Legal History' offer an original and compelling history of the symbolism through which law is characterised as being 'above' us. In 'The Eye of the Law', the history of this metaphor is followed from antiquity through to the present day: from the Greek Eye of Justice, the eye of the impartial judge of the Underworld, the Eye of God watching past, present and future, the Eye of the Prince, guiding his subjects, to the almighty Eye of the Law. While our belief in the law may have become brittle, nothing escapes what is now the Eye of Big Brother. 'In the Name of the Law' takes up the various formulas used to legitimate the decisions of the courts, from the times of absolutism over the 19th century until today. The speaker who speaks in the name of a higher being underlines his function: his authority comes from above. And it is 'in the name of' god, king, people, state, nation, or law, that a weak, earthly, justice receives its support

Moderne Strafrechtsgeschichte als Teil der juristischen Zeitgeschichte befasst sich mit der Rechtsentwicklung in unserer Rechtsepoche. Diese umfasst, wie im Einleitungskapitel dargelegt wird, das 19. und 20. Jahrhundert. Unter Berücksichtigung der allgemeinen geschichtlichen Entwicklung einerseits, der Bezüge zur Gegenwart andererseits bietet das Buch eine anschauliche Darstellung der (vorwiegend deutschen) modernen Strafrechtsentwicklung unter Einbeziehung der jüngsten Entwicklung, die in einem abschließenden Kapitel als „juristisches Zeitgeschehen" behandelt und gewürdigt wird. Es setzt Schulkenntnisse in allgemeiner Geschichte und Grundkenntnisse des Strafrechts voraus und erwartet im Übrigen von den Leserinnen und Lesern nur Aufgeschlossenheit für geschichts- und rechtstheoretische Fragestellungen.

L'aspiration à la justice est, pour le meilleur et pour le pire, une donnée anthropologique fondamentale, car les hommes ont besoin pour vivre ensemble de s'accorder sur un même sens de la vie, alors qu'elle n'en a aucun qui puisse se découvrir scientifiquement. La dogmatique juridique est la manière occidentale de lier ainsi les hommes. Le Droit est le texte où s'écrivent nos croyances fondatrices : croyance en une signification de l'être humain, en l'empire des lois ou en la force de la parole donnée. N'étant pas l'expression d'une Vérité révélée par Dieu ou découverte par la science, le Droit est aussi une technique, susceptible de servir des fins diverses et changeantes, aussi bien dans l'histoire des systèmes politiques que dans celle des sciences et des techniques. Mais c'est une technique de l'Interdit, qui interpose dans les rapports de chacun à autrui et au monde un sens commun qui le dépasse et l'oblige. Il faut en effet que chacun de nous soit assuré d'un ordre existant pour pouvoir donner sens à sa propre vie et à son action, fût-elle contestatrice.

My dissertation for LLD (or JSD) Att beskriva rätten (To Describe Law), which was written under my bachelor surname of Andréasson, was presented for public exa- nation on Nov 4, 2004. Since then the text has been developed in two separate directions. On the one hand, three of the chapters have been made more accessible to students of jurisprudence and have been included in the second edition of the te- book Rättsfilosofi, samhälle och moral genom tiderna edited by Joakim Nergelius. On the other hand, the whole dissertation has been revised, translated and published as the present book. In the time that has passed since my dissertation, many things have changed. On the personal level, my friend and tutor, Aleksander Peczenick, was sadly taken away from my circle of colleagues. In contrast to that sad event, I have spent two nine-month periods on paternity leave, raising my two children, Selma and Bernhard. This past year, I have decided to move from theory to practice and have started working in a court of law. During my work on the dissertation, I had the opportunity to spend a rewarding term at Rutgers University in Camden, NJ visiting Professor Dennis Patterson. Since this book is a continuation of that project, it feels appropriate to repeat my thanks to Professor Patterson and STINT (The Swedish Foundation for International Cooperation in Research and Higher Education) for making that visit possible.
