Does international law make individuals responsible for perpetrating war crimes during internal armed conflicts? Eve La Haye explores the content of international criminal law applicable in such conflicts and questions the 1995 finding of the Appeals Chamber of the International Criminal Tribunal for the Former Yugoslavia that responsibility could be enforced on the basis of customary international law. This finding is evaluated with regard to state practice and the practice of international organisations. The means to enforce individual criminal responsibility for such crimes are also investigated. The states on whose territory the crimes took place have sometimes tried such perpetrators, but can other states prosecute perpetrators of war crimes under the principle of universal jurisdiction? The applicability of universal jurisdiction to war crimes committed in civil wars and the practice of domestic courts are examined, alongside the role and achievements of prosecutions carried out by international courts and tribunals.

Attempts to introduce democracy in the wake of civil war face a critical problem: how can war-torn societies move towards peace and democracy when competitive politics and hard-fought elections exacerbate social and political conflict? Through a study of six themes (peacekeeping, management of violence, power sharing, political party transformation, elections, civil society and international reactions to democratization crises) this volume considers the dilemmas that arise in pursuing peace after civil war through processes of democratization. The contributors' research highlights the complex relationship between democratization, which is competitive, and peacebuilding or efforts to achieve reconciliation. The book offers insights into more effective action in peacebuilding in light of the short-term negative effects that democratization can introduce. It is a thought-provoking work that seeks both to advance theory and to provide policy-relevant findings to facilitate more effective and durable transitions from war to democracy.

In the transition from war-torn societies to stable multiparty democracies, what is the role of former rebel leaders? Can rebel movements effectively transform themselves from military to political organizations? From Soldiers to Politicians explores when and how militias succeed in reorienting their goals and practices toward legitimate political activities. The authors present eight theoretically grounded country studies, focusing in each on the historical background of the rebel movement, its (attempted or successful) transformation into a political party, and the factors explaining success or failure. Civil wars pose some of the most difficult problems in the world today and the United Nations is the organization generally called upon to bring and sustain peace. Lise Morjé Howard studies the sources of success and failure in UN peacekeeping. Her in-depth 2007 analysis of some of the most complex UN peacekeeping missions debunks the conventional wisdom that they habitually fail, showing that the UN record actually includes a number of important, though understudied, success stories. Using systematic comparative analysis, Howard argues that UN peacekeeping succeeds when field missions establish significant autonomy from UN headquarters, allowing civilian and military staff to adjust to the post-civil war environment. In contrast, failure frequently results from operational directives originating in UN headquarters, often devised in relation to higher-level political disputes with little relevance to the civil war in question. Howard recommends future reforms be oriented toward devolving decision-making power to the field missions.
