This is the third book to be produced by members of the Gambling Research Group – associated with Tilburg University’s Faculty of Law concerning issues closely connected with the debate on the gambling policies that the European Union and its Member States are pursuing. The first book – Alan Littler and Cyrille Fijnaut (eds), The Regulation of Gambling: European and National Perspectives (Leiden, Martinus Nijhoff Publishers, 2007) – mainly considers the legal aspects of gambling regulation, at both European Union and Member State level. The second book – Tom Coryn, Cyrille Fijnaut and Alan Littler (eds), Economic Aspects of Gambling Regulation: EU and US Perspectives (Leiden, Martinus Nijhoff Publishers, 2008) – looks at research conducted in the United States and the European Union into the costs and benefits involved in the regulation of gambling. The contributions to this third book turn the spotlight on two social problems: crime and addiction, both of which play a significant part in the institutional debate in the European Union concerning whether gambling should be treated as a service that – like other services – should be subject to the laws universally applicable to the internal market. This volume is primarily devoted to the research that has been conducted in several Member States into the problems of gambling-related crime and addiction. It also examines developments at EU level: What policy is the European Commission currently pursuing? And what stance does the European Court of Justice take these days? Crime and addiction problems that can arise in the context of online gambling and at possible ways of keeping them under control. are also examined.

The dynamic discussions which took place at the Colloquium on the Economic Aspects of Gambling Regulation: EU and US Perspectives, hosted by Tilburg University, are reflected in this book. It brings together a wide range of perspectives from the contemporary debate surrounding the regulation of gambling from within the context both of the EU and the USA. Not only does the book encompass both ends of the spectrum of the current discussion; it also brings together the perspectives of academics, lawyers and operators. Debates surrounding the regulation of gambling have been increasing in terms of frequency and ferocity, at the national, European and international levels. Within the Member States of the European Union there has been considerable debate as to the appropriate method of regulating gambling, in particular with a view to securing revenue streams for good causes. Concurrently, infringement proceedings of the European Commission and the case-law of the European Court of Justice have the potential to disrupt chosen regulatory approaches and thus long established revenue flows. This is but one of the economic aspects to the regulation of gambling which to date has not been explored within Europe to the extent seen in the United States. Lessons which European jurisdictions can learn from American experiences in this field, and discussions on the state-of-the-art of gambling economics in Europe today, form the basis of this dynamic book.

Mit seiner Sportwetten-Grundsatzentscheidung vom 28. März 2006 hat das Bundesverfassungsgericht die verfassungsrechtlichen Rahmenbedingungen für das Glücksspielwesen in Deutschland präzisiert und den Gesetzgeber mit dessen Neuregelung beauftragt. Zum 1. Januar 2008 ist mit dem von allen Länderparlamenten ratifizierten Glücksspielstaatsvertrag und ergänzenden Landesgesetzen ein neues Glücksspielrecht in Deutschland in Kraft getreten. Allein die Ziele der Suchtvermeidung und Suchtbekämpfung rechtfertigen nach den Feststellungen des Bundesverfassungsgerichts Glücksspielmonopole, durch die private Glücksspielanbieter vom deutschen Glücksspielmarkt ausgeschlossen werden. Damit rücken neben ökonomischen und rechtlichen Fragen gerade auch die Erkenntnisse der Glücksspielsucht-Forschung in den Mittelpunkt des Interesses. Dem versucht dieses interdisziplinär angelegte Buch Rechnung zu tragen, indem namhafte Wissenschaftler und Praktiker - Ökonomen, Juristen, Suchtfachleute - das Glücksspielwesen umfassend analysieren. Die Autoren beziehen Position und verdeutlichen die unterschiedlichen Sichtweisen und Interessenlagen zum Thema. Das Buch gibt dem Leser zugleich eine Idee von der geschichtlichen Dimension und der Bedeutung des Glücksspiels für den Einzelnen und die Gesellschaft insgesamt.
