Abstract

Mason looks at the legal response to those aspects of the troubled pregnancy which require or involve medico-legal intervention. The unwanted pregnancy is considered particularly in the light of the Abortion Act 1967, s.1(1)(d) and the related action for so-called wrongful birth due to faulty ante-natal care. The unexpected or uncovenanted birth of a healthy child resulting from failed sterilisation is approached through an analysis of the seminal case of McFarlane and associated cases involving disability in either the neonate or the mother. The disabled neonate's right to sue for its diminished life is discussed and the legal approach to the management of severe congenital disease is analysed - thus following Baroness Hale in believing that care of the newborn is an integral part of pregnancy. Aspects are considered from historical and comparative perspectives, including coverage of experience in the USA, the Commonwealth and Europe.

Abstract

The law of torts is concerned with the obligations that are created by the infringement of rights. This work seeks to show that this apparently simple proposition provides the groundwork for a theoretical model for conceiving the law of torts, and a way of understanding the subject.

Abstract

In Unlucky to the End Richard Pound provides a detailed and thought-provoking examination of the circumstances of the robbery, the subsequent flight of the suspects and murder of the policeman, as well as the hostage scene that led to the death of one of the robbers. He uses transcripts from the Calgary trial to explore Gamble's conviction and details the efforts that, after fourteen years in the desolate Kingston Prison for Women, finally led to her parole.

Abstract

This volume of the ""Digest of European Tort Law"" is the first product of a most ambitious research project: a collection of court decisions from almost all European jurisdictions on the most fundamental aspects of tort law. These cases are not only accumulated, but also structured, analysed and commented both from a national as well as a comparative perspective. Historical aspects are also considered, as are future trends, as outlined by current projects on the harmonisation of European tort laws. This complex comparative study shall thereby not only offer guidance for researching cross-bord
