Abstract

"This is a book about the ever more complex legal networks of transnational economic governance structures and their legitimacy problems. It takes up the challenge of the editors' earlier pioneering works which have called for more cross-sectoral and interdisciplinary analyses by scholars of international law, European and international economic law, private international law, international relations theory and social philosophy to examine the interdependences of multilevel governance in transnational economic, social, environmental and legal relations. Two complementary strands of theorising are expounded. One argues that globalisation and the universal recognition of human rights are transforming the intergovernmental "society of states" into a cosmopolitan community of citizens which requires more effective constitutional safeguards for protecting human rights and consumer welfare in the national and international governance and legal regulation of international trade. The second emphasises the dependence of the functioning of international markets and liberal trade on governance arrangements which respond credibly to safety and environmental concerns of consumers, traders, political and non-governmental actors. Enquiries into the generation of international standards and empirical analyses of legalization and judizialisation practices form part of this agenda. The perspectives and conclusions of the more than 20 contributors from Europe and North-America cannot be uniform. La réciprocité des engagements contractualise la régulation, l'assouplit sans la dissoudre pour autant dans le droit de la concurrence : les contrats, comme figure et comme techniques, triomphent. Pourtant, le droit des contrats, dans sa conception générale de l'engagement et dans la façon dont les contrats sont utilisés, est souvent malmené dans les secteurs régulés. Le lien engendre ainsi une porosité des deux termes : les engagements prospèrent mais en tant qu'outils incitatifs pour obtenir de chacun des comportements attendus par la bonne fin du système. Les secteurs se gouvernent par les contrats. Conception dialectique, s'il en est. L'ouvrage ouvre le thème des engagements dans les systèmes de régulation économique à travers le couple ex ante/ex post. Abstract

This compilation of data is prepared as a companion to the Bank's research project on distortions to agricultural incentives. Its purpose is to provide comparative basic economic and trade indicators for the countries involved as case studies in that project. The project is global in coverage, and is sub-divided into five groups: Africa, Asia, Europe and Central Asia's Transition Economies, Latin America and the Caribbean, and high-income countries. The present compendium is divided into seven main sections. The first one includes data on high income countries which are compared with three aggregates for developing countries. Sections two through five focuses indeed specifically on one of the four regional groups and compare data for the case study countries with various aggregates of studied and not studied countries. Due to the very limited data availability several countries have not been included in the compendium. Finally, section six and seven include estimates of trade distortions, and sectoral shares of value added and household expenditures for all the studied countries and several regional aggregates.

Abstract

Banking Regulation and World Trade Law concerns the legal aspects of the interaction between banking regulation and international trade in financial services. The author studies the internal banking market of the European Union, the liberalisation of financial services trade in the World Trade Organization, the accords of the Basel Committee on Banking Supervision and the European Central Bank. The book focuses on the balancing between banking regulation and international trade law. It discusses discrimination and proportionality in national banking regulation, the allocation of prudential regulation and supervision between home and host country, and international financial law-making. The author questions decentralised/nation-based banking regulation and supervision as a foundation for a sustainable liberalisation of international trade in financial services. The book considers various reforms of the international financial architecture, such as the incorporation of the Basel processes and accords into the WTO system, and the setting up of new international institutions by building on the Basel Committees or the IMF structures. The role of central banking in designing the international financial architecture is also explored: the book reviews the ECB's competence over foreign exchange policy and its function as lender of last resort, and treats price stability, banking soundness and representation as critical concepts. The analysis also reveals that the concept of 'prudential', despite its extensive use in banking regulation, has not been defined with adequate precision. In seeking to delineate the interface between international economic law and banking regulation, Dr Panourgias builds on the rich European scholarship on institutional financial issues and the US interdisciplinary approach to world trade law. Abstract

"Standards and technical regulations are an increasingly prominent part of the international trade policy debate. In particular, there has been considerable discussion of whether standards and regulations affect trade costs and export prospects for developing countries. In this paper the authors examine how meeting foreign standards affects firms' export performance, reflected in export propensity and market diversification. The analysis draws on the World Bank Technical Barriers to Trade Survey database of 619 firms in 17 developing countries. The results indicate that technical regulations in industrial countries adversely affect firms' propensity to export in developing countries. In particular, testing procedures and lengthy inspection procedures reduce exports by 9 percent and 3percent, respectively. Furthermore, in the model, the difference in standards across foreign countries causes diseconomy of scale for firms and affects decisions about whether to enter export markets. The empirical analysis presented here implies that standards impede exporters' market entry, reducing the likelihood of exporting to more than three markets by 7 percent.
