Le Tribunal international du droit de la mer est un organe judiciaire indépendant, créé par la Convention des Nations Unies sur le droit de la mer, pour connaître des différends auxquels pourraient donner lieu l'interprétation et l'application de la Convention. Le Tribunal est ouvert aux Etats Parties à la Convention. Il est également ouvert à des entités autres que les Etats Parties (Etats et organisations internationales non parties à la Convention et personnes physiques et morales) dans les cas prévus par la Convention ou par d'autres accords conférant compétence au Tribunal. L'Annuaire offre aux juristes, aux universitaires, aux étudiants, ainsi qu'au public dans son ensemble, l'accès à des informations concernant la compétence, la procédure et l'organisation du Tribunal, ainsi que la composition et les activités de celui-ci au cours de l'année 2004. L'Annuaire est établi par le Greffe du Tribunal et est aussi disponible en anglais (Yearbook 2004).

The International Tribunal for the Law of the Sea, a judicial institution created by the 1982 United Nations Convention on the Law of the Sea, began its activities on 1 October 1996. Together with the Statute of the Tribunal (Annex VI to the Convention), the Rules of the Tribunal, adopted on 28 October 1997, govern the functioning of the Tribunal and the proceedings before it. The objective of this Commentary is to give to legal practitioners and academics a detailed analysis of the provisions contained in the Rules. In doing so, the contributors, who are Judges of the Tribunal or members of its Registry, paid particular attention to the practice and the jurisprudence of the Tribunal as well as to the corresponding provisions in the Rules of the International Court of Justice.

This work deals with the question of unlawful territorial situations, id est territorial regimes that are established and maintained in defiance of international law. It represents a very timely contribution to the debate concerning the nature, the aims and purpose of foreign interventions in the affairs of sovereign countries. International lawyers have focussed on the important questions of the legal regime applicable to the conduct of the occupant and the authoritative decision-making processes by international institutions, but often neglected the broader and decisive question of the legality of the ‘foreign’ or ‘international’ presence as such. The author shows the relevance and, sometimes irrelevance, of international law to the determination of legality or illegality of the occupation, and how legal norms incorporate and interact with the concepts of effectiveness and legitimacy. This book is the result of the Council of Europe Pilot Project on State Practice Regarding State Immunities carried out under the auspices of the Committee of Legal Advisers on Public International Law (CAHDI) since 2002. It presents and analyses the material submitted by 27 Member States and one Observer State of the Council of Europe, including decisions of national courts, relevant legislation and other documents. The analytical report was undertaken by the Department of European, International and Comparative Law of the University of Vienna, the British Institute of International and Comparative Law and the Graduate Institute of International Studies, Geneva. It compares State practice with the relevant articles of the UN Convention, the European Convention on State Immunity and the draft articles prepared by academic institutions. It is the first in depth-analysis of European State practice in the field of State immunity. Such a broad analysis is essential, in particular for the ascertainment of customary international law. This book is addressed to officials, practitioners engaged in business relations with foreign States, and academics. The popularity of his monumental and definitive works have established Shabtai Rosenne as the undisputed expert on the International Court of Justice’s law and practice.
