This publication is a summary of the presentations and discussions that took place during the meeting on "Voluntary Standards and Certification for Responsible Agricultural Production and Trade" organized by FAO in April 2004. It presents the situation of the main import markets for certified products and the evolution of demand. Case studies aimed at comparing sustainable farming methods with conventional methods are presented. These comparisons focus on production cost, yield, price premium and net profit. The difficulties with which the producers are confronted are analysed and possible solutions to overcome them are explored. The publication also discusses the roles of nongovernmental organizations, private stakeholders and other institutions involved in sustainable agriculture and explores possibilities for greater collaboration among them.

"Since the mid-1980s, beginning with the unsuccessful Union Carbide litigation in the USA, litigants have been exploring ways of holding multinational corporations [MNCs] liable for offshore human rights abuses in the courts of the companies' home States. The highest profile cases have been the human rights claims brought against MNCs (such as Unocal, Shell, Rio Tinto, Coca Cola, and Talisman) under the Alien Tort Claims Act in the United States. Such claims also raise issues under customary international law (which may be directly applicable in US federal law) and the Racketeer Influenced and Corrupt Organizations [RICO] statute. Another legal front is found in the USA, England and Australia, where courts have become more willing to exercise jurisdiction over transnational common law tort claims against home corporations. Futhermore, a corporation's human rights practices were indirectly targeted under trade practices law in groundbreaking litigation in California against sportsgoods manufacturer Nike. This new study examines these developments and the procedural arguments (eg. regarding personal jurisdiction and especially forum non conveniens) which have been used to block litigation, as well as the principles which can be gleaned from cases which have settled. The analysis is important for human rights victims in order to know the boundaries of possible available legal redress. It is also important for MNCs, which must now take human rights into account in managing the legal risks (as well as moral and reputation risks) associated with offshore projects."--Bloomsbury Publishing.

This accessible and provocative book explores whether getting 'unhooked' from economic growth to meet the needs of the environment is possible. Although giving the environment priority over growth may seem radical, the author argues that it can be accomplished using marketable emissions allowances, transferable development rights, and other tools popular with conventional economists. It can also be achieved by creating more interesting and environmentally friendly urban landscapes less beholden to the automobile. The key problem will be ensuring that everyone who wants employment can find it.

"The tension between trade liberalisation and environmental protection has received remarkable attention since the establishment of the WTO. It has been the subject of a wide-ranging debate, and is one of the central themes of the anti-globalisation movement. This book explores that debate. It argues that by focusing on the WTO, the debate has failed to recognise the institutional and discursive complexity in which the trade-environment conflict is embedded. A legal investigation of this nexus requires a framework of inquiry, in which this complexity can be elucidated - a model of global legal pluralism. The first theoretical part of the book (Chapters One and Two) responds to this challenge by developing a pluralistic model, which recognises the trade and environment conflict as the product of multiple dilemmas, constituted and negotiated by a myriad of institutional and discursive networks. As such, this conflict cannot be understood or addressed through one-dimensional models. Viewing the trade-environment conflict through a pluralistic perspective yields important practical insights. It means that this conflict cannot be resolved by uniform economic or legal formulae. Dealing with this conflict requires, rather, polycentric and contextual strategy. The empirical part of the book (Chapters Three to Seven) explicates this thesis by examining several global legal domains, ranging from the WTO to 'private' transnational regimes such as transnational litigation, international construction law and international financial law. This part demonstrates how the different discursive and institutional structures of these domains have influenced the contours of the trade-environment conflict, and considers the policy implications of this diversity from a pro-environmental perspective."--Bloomsbury Publishing.
