Was slavery over when slaves gained formal emancipation? Was it over when the social, economic, and political situation for African Americans no longer mimicked the conditions of slavery? If the Thirteenth Amendment abolished it in 1865, why did most of the disputed points during the Reconstruction debates of 1866–75 concern issues of slavery? In this book Pamela Brandwein examines the post–Civil War struggle between competing political and legal interpretations of slavery and Reconstruction to reveal how accepted historical truth was established.Delving into the circumstances, assumptions, and rhetoric that shaped the “official” story of Reconstruction, Brandwein describes precisely how a dominant interpretation of events ultimately emerged and what its implications have been for twentieth-century judicial decisions, particularly for Supreme Court rulings on civil rights. While analyzing interpretive disputes about slavery, Brandwein offers a detailed rescoring of post–Civil War legislative and constitutional history, including analysis of the original understanding of the Fourteenth Amendment. She identifies the perspectives on Reconstruction that were endorsed or rejected by the Supreme Court. Explaining what it meant—theoretically and practically—to resolve Reconstruction debates with a particular definition of slavery, Brandwein recounts how the Northern Democratic definition of “ending” slavery was not the only definition, just the one that prevailed. Using a familiar historical moment to do new interpretive work, she outlines a sociology of constitutional law, showing how subjective narrative construction can solidify into opaque institutional memory.

Abstract

In the decade of the end of the war, the theme of the reconciliation of the Lebanese structures political discourse and serves to justify major planning actions, as well as individual or collective strategies. Even more than the end of the fighting, the promise of a new era of coexistence and prosperity legitimizes ambitious reconstruction projects. In return, the construction of equipment and infrastructure, the resumption of development dynamics, as well as the rehabilitation of the living environment are supposed to promote reconciliation. This CERMOC book is the result of research and reflections by a team of anthropologists, geographers, sociologists, political scientists and town planners, led by Eric Huybrechts, head of the Beirut and Reconstruction Research Observatory. , and Chawqi Douayhi, professor at the Lebanese University. The authors have identified and studied various representative places of reconstruction and reconciliation, chosen either for their originality or from particular angles: the reconstruction of the villages around Saïda, the new political and social balance between Tripoli and Zgorta in through the study of the space of the Lebanese University in Qobbé, the social mix on the Corniche and in the commercial centres of Beirut, the forgetting of the old line of fighting in the reconstruction of Beirut and its suburbs, etc. . Several readings can be made of these recompositions: a normalization of social relations, the resumption of metropolitan and globalizing dynamics, a complexification of society, or even the continuation of the political struggle by means other than war.

Abstract

Following the devastation of the war in Bosnia, the European Union formed the European Union Administration of Mostar (EUAM) and John Yarwood - a widely experienced architect, town planner and project manager - worked as Director of Reconstruction for EUAM for the whole of the period of its mandate, from 1994 to 1996. On behalf of the international community, the EU formed a city administration in Mostar with the goal of reconciling the former warring parties; building security and creating a unified police force; establishing freedom of movement; holding democratic elections; and establishing a City Council. It also spent DM170 million on repairing 6000 houses, 30 public buildings, 25 schools, 18 health buildings, 70 water projects, 5 bridges, a construction equipment pool and a technical training centre. Ninety buildings were de-mined and an urban planning system was established. This was a project of unique historical significance from many points of view. In a book extensively illustrated with photographs and plans, Yarwood and his collaborators describe reconstruction from a general technical standpoint. The book shows what was done; explains how it was done; and considers the problems, issues, failures and successes. It analyses what lessons were learned and points out the relevance for similar future projects. The analysis is firmly grounded in the context of Bosnian and European politics.
