Le droit des sûretés et des privilèges a connu récemment d’importantes réformes législatives, dont la plus remarquable est sans nul doute la loi du 11 juillet 2013 modifiant le Code civil en ce qui concerne les sûretés réelles mobilières, laquelle a été amendée à de multiples reprises tant avant qu’après son entrée en vigueur, le 1er janvier 2018.Cette loi a notamment modifié en profondeur le régime du gage en instaurant, aux côtés du gage traditionnel, le gage de registre, dit aussi « gage sans dépossession ». L’introduction de cette nouvelle forme de gage, et la révolution de son concept même, s’est accompagnée d’autres innovations cruciales pour la matière, telles la disparition du gage sur fonds de commerce, la suppression du warrantage ou encore celle de certains privilèges.Le présent Manuel entend ainsi donner au lecteur un compte-rendu aussi exhaustif que possible de cette matière complexe et évolutive. Tous les types de sûretés, mobilières et immobilières, sont abordés, ainsi qu’un nombre conséquent de privilèges légaux. L’articulation du droit des sûretés avec le droit des procédures collectives (réorganisation judiciaire, faillite) est systématiquement traitée, à la lumière du nouveau Livre XX du Code de droit économique.L’ouvrage propose également une étude actualisée du rang et du concours des sûretés réelles et des privilèges.Enfin, il présente une analyse des différents mécanismes préférentiels issus du droit des obligations (exception d’inexécution, compensation, paiement volontaire etc.).

The US subprime mortgage crisis, by nearly causing the collapse of the global financial system during the 2007-08 financial crisis, clearly revealed that household debt management is critical to the stability of the international economy. The configuration of mortgage finance systems of European economies, from the UK to Sweden to Spain, have profound effects on national macroeconomic and political outcomes.
In this book, Gregory Fuller reveals how national housing systems diverge in terms of their commodification and financialization: mortgages are far more common in some systems than others; some encourage families to treat housing as a tradeable asset while others do not; and certain states provide extensive social housing programmes while others offer virtually none. These differences are shown to have an impact on households' economic precarity, macroeconomic volatility, and ultimately on their political preferences. Drawing on these comparisons, Fuller offers a number of policy suggestions intended to weaken the links between housing, economic instability, and inequality.
