Ce quatrième volume de la grande matière 'Marché intérieur' du Commentaire J. Mégret porte sur deux thèmes différents mais complémentaires, une introduction au marché intérieur, d'une part, et une étude de la libre circulation des marchandises, d'autre part. L'introduction au marché intérieur aurait pu figurer en tête de tous les volumes de la grande matière mais il a semblé que le recul des trois premiers volumes permettait d'avoir une vue plus claire de la situation, surtout après avoir franchi le cap des vingt ans du grand marché intérieur, lancé par la Commission dans son célèbre livre blanc de 1985 et presque définitivement achevé en 1992. Le marché intérieur, héritier du marché commun qui a longtemps symbolisé la Communauté européenne, reste une des principales réalisations de l'Union européenne ; il en forme le socle, sur lequel se sont greffées toutes les avancées ultérieures. Le livre I de l'ouvrage permet d'en avoir une vue synthétique et d'approcher les quatre grandes libertés traditionnelles dans une vision d'ensemble, coordonnée et synthétique, et dans une perspective dynamique. Le marché intérieur constitue une création permanente, dont la réalisation complète nécessite des efforts continus. L'analyse s'efforce de souligner que le marché intérieur ne se limite pas aux quatre libertés qui en forment les composantes et qu'il ne doit pas être envisagé uniquement comme un espace de libre circulation mais aussi comme un ensemble normatif encadrant les libertés et visant à en assurer le bon fonctionnement et la pérennité

The book examines the twofold 'boundaries' of the concept of the European Union's internal market - the geographical and the substantive - through the prism of expanding the internal market to third countries without enlarging the Union. The book offers a comprehensive analysis of the conditions under which the internal market can effectively be extended to third countries by exporting EU acquis via international agreements without sacrificing its defining characteristics. Theoretical rather than empirical in approach, the book scrutinises and meticulously questions the required level of uniformity within flexible integration relating to the substantive scope of the internal market, the role of foundational principles in the European Union's market edifice, and the institutional framework necessary for granting third country actors full participation in the internal market while safeguarding the autonomy of the Union's legal order.
