Enforcement or Negotiation presents a study of the development and operations of the federal Office of Surface Mining Reclamation and Enforcement during its first four years (1978-82), with special emphasis on the issue of regulatory enforcement. It examines the causes and consequences of the agency's change from an enforced compliance style of regulation toward a more discretionary negotiated compliance .The analysis is grounded in a variety of methods, including personal interviews, examination of archival data, and structured questionnaires. A comparative analysis of how the legislation was implemented differently in two regions of the United States demonstrates the crucial importance of local conditions on the implementation of regulatory mandates. The OSM's efforts to balance demands for equity and efficiency are documented, as well as the differences in oppositional strategies employed by large and small mining companies.

The future of mining in South Africa is hotly contested. Wide-ranging views from multiple quarters rarely seem to intersect, placing emphasis on different questions without engaging in holistic debate. This book aims to catalyse change by gathering together fragmented views into unifying conversations. It highlights the importance of debating the future of mining in South Africa and for reaching consensus in other countries across the mineral-dependent globe. It covers issues such as the potential of platinum to spur industrialisation, land and dispossession on the platinum belt, the roles of the state and capital in mineral development, mining in the era of the Fourth Industrial Revolution, the experiences of women in and affected by mining since the late 19th century and mine worker organising: history and lessons and how post-mine rehabilitation can be tackled. It was inspired not only by an appreciation of South Africa's extensive mineral endowments, but also by a realisation that, while the South African mining industry performs relatively well on many technical indicators, its management of broader social issues leaves much to be desired. It needs to be deliberated whether the mining industry can play as critical a role going forward as it did in the evolution of the country's economy.

La République démocratique du Congo est un scandale géologique. C’est dans ce contexte que l’ouvrage propose, sous une forme inédite, une démarche rationnelle pour répondre à cette préoccupation. Soucieux du contexte historique et du cadre socio-politique du moment, l’auteur rappelle en premier lieu les différentes législations minières d’époques précoloniale, coloniale et postcoloniale du pays jusqu’à ce jour, accompagnées d’annotations et de commentaires pour une meilleure compréhension de l’esprit du législateur. Ensuite, après avoir fait le bilan du passé et relevé les points forts et les point faibles de la situation présente, l’auteur propose une nouvelle méthodologie de travail et plusieurs recommandations pour l’élaboration des révisions futures du code minier. Cet ouvrage s’adresse à plusieurs acteurs du secteur minier congolais notamment les historiens, les géologues, les économistes, les ingénieurs, le secteur académique, les investisseurs miniers, les praticiens de droit, ainsi que les décideurs politiques.
