Verschillende rechters, waaronder ook de Belgische rechter, stelden overheden aansprakelijk voor klimaatopwarming. In eerste aanleg beperkte de Belgische rechter zich tot een verklaring voor recht dat de overheid door een tekortschietend klimaatbeleid de algemene zorgvuldigheidsnorm en mensenrechten heeft geschonden. In hoger beroep gaat het hof van beroep te Brussel nog een stap verder. Het hof legt een reductiebevel op aan de Belgische overheden om de CO2-uitstoot op het Belgische grondgebied tegen 2030 met ten minste 55 % te verminderen, ten opzichte van het volume van 1990. Deze remedie blijft echter niet zonder kritiek. Deze masterscriptie onderzoekt welke remedies passend zijn voor de Belgische rechter om te bevelen in het licht van overheidsaansprakelijkheid voor klimaatopwarming. Ter inspiratie analyseert dit onderzoek de remedies die rechters wereldwijd reeds hebben bevolen in klimaatzaken tegen de overheid. Alvorens deze masterscriptie een antwoord formuleert op de (normatieve) onderzoeksvraag, gaat het onderzoek dieper in op twee andere vragen: wat mag de rechter en wat kan de rechter ?
