Abstract

Courts with the right to constitutional review exert considerable power in a political system. However, especially for Kelsenian constitutional courts there are hardly any large-N studies. This is mainly due to a lack of data. For the German Federal Constitutional Court, this gap has been closed by building a novel database, the development of which is depicted in this book. Employing data from this database, the occurrence of separate opinions in general and their different types in particular are analyzed. The book introduces a new, universal theory that reconciles and expands existing explanations. In a second step, the theory is applied to the German Federal Constitutional Court. It can be proven that one factor that has been neglected so far plays a decisive role: The judges' behavior depends on the profession they pursue after their time in office. Moreover, the study shows that -- contrary to the common literature -- it is not mainly the topic that determines a case's conflict potential but rather the number of issues a decision has to address.

Abstract

At a time when increased independence requirements for auditors, legal backing for auditing standards, and increased audit documentation requirements have occurred, this book examines key issues in the market for audit services in Australia. It investigates issues including: the understandability of audit and the state of the audit expectations gap; auditors’ business acumen and industry expertise; the auditors’ use of materiality; whether or not the increasingly prescriptive nature of auditing is creating a distraction from the ‘real’ audit task and stifling auditors’ judgement; whether or not CLERP 9 reforms involving audit partner rotation and restrictions on non-audit service provision are efficient and effective and reactions to the increasing scrutiny of auditors and audit firms by regulators. With its thorough coverage of contemporary issues, this book intersperses the authors’ summaries, interpretations and recommendations with the perceptions, expressed in their own words in order to faithfully convey their candid assessments, of users of audit reports, purchasers and suppliers of the audit product, auditing standard setters and regulators of the audit market.

Abstract

Abstract

This report outlines the rules on the taking and using of evidence in Austrian civil procedure law. On the basis of principles such as the free disposition of parties, the attenuated inquisitorial principle or the principles of orality and directness, the judge and the parties form a “working group” when investigating the matter in dispute. The Austrian concept of an active judge, however, goes along with the judge’s duty to do case-management and especially to induce a truthful fact-finding using judicial discretion. While only five means of proof (documents, witnesses, expert opinions, evidence by inspection and the examination of parties) are explicitly listed the Austrian civil procedure code, there is no numerus clausus regarding the means of evidence. Evidence may be freely assessed by the judge.

Abstract

All judges legitimize their decisions in writing, but US Supreme Court justices depend on public acceptance to a unique degree. Previous studies of judicial opinions have explored rhetorical strategies that produce legitimacy, but none have examined the laudatory, even operatic, forms of writing Supreme Court justices have used to justify fundamental rights decisions. Doug Coulson demonstrates that such "judicial rhapsodies" are not an aberration but a central feature of judicial discourse. First examining the classical origins of divisions between law and rhetoric, Coulson tracks what he calls an epideictic register--highly affective forms of expression that utilize hyperbole, amplification, and vocabularies of praise--through a surprising number of landmark Supreme Court opinions. Judicial Rhapsodies recovers and revalues these instances as significant to establishing and maintaining shared perspectives that form the basis for common experience and cooperation.

Abstract

This Special Issue on ‘Sustainability and Visitor Management in Tourist Historic Cities’ explores new trends and methods that contribute to sustainable practices for tourism planning and management in historic cities. Thanks to the differentiated approaches adopted by the authors, the Special Issue reflects on the environmental, physical, cultural, and social effects that tourism activity provokes in tourist historic cities. Considering the present debate on tourism in historic cities, there is a special focus on resident perceptions and the social problems and conflicts associated with various tourist activities that have emerged in recent years. New methodologies and sources to measure tourism impacts are also addressed in this book, especially the use of big data technology, another relevant topic. Papers include one literature review and six case studies in the historic cities of Seville and Toledo (Spain), Venice and Matera (Italy), and Porto (Portugal) and Popayán (Colombia). This Special Issue provides practical tools and policy recommendations to measure tourism impacts and promote sustainable management in tourist historic cities.

Abstract

How can the modern individual control his or her self-representation when the whole world seems to be watching? The question is not a new one. Julia Fawcett traces it back to 18th-century London - and to the strange and spectacular self-representations performed there by England's first modern celebrities.

Abstract

Between 1991 and 2001, the size of Britain's ethnic minority population increased by a full fifty percent. In that same decade, approximately one million immigrants settled in Britain. Similar patterns of migration and settlement are taking place in other European countries, such as Germany and France. The Dynamics of Migration and Settlement in Europe explores the causes and consequences of such massive changes in demography. Researchers at the IMISCOE-Network of Excellence (Immigration, Integration and Social Cohesion in Europe) bring together a wealth of theoretical and analytical research in this collection of essays addressing the many crucial questions that have arisen in the past two decades. Underlying these essays is a key concern for the healthy management of these new migration processes, as well as the eventual shape of the new societies that are just beginning to emerge. International migration and the ensuing questions about integration continue to be subjects of intense debate, and this book will be welcomed among those involved in migration studies and international development.
