Abstract

The role of psychologists, both in the courtroom and at the crime scene, is rapidly expanding. Surveying a wide range of international court cases, "The Popular Policeman and Other Cases " the critical - and often misunderstood - intersection of psychology and law. The authors, both expert psychologists with extensive experience in the courtroom, are quite familiar with the fundamental differences between the law and psychology as an empirical science. As well as dealing with well-known and controversial issues such as recovered memories or false confessions, "The Popular Policeman and Other Cases" examines a variety of less traditional criminal topics, including illegal gambling, trademark litigation, and the perils of risky courtship behavior. Each chapter reviews an actual case, appraises the relevant scientific research, and then demonstrates how psychological insights were introduced within the courtroom. The authors conclude by noting the outcome of each case - and how their research played a role in the decision. Abstract

"Vision traditionally occupies the height of the sensorial hierarchy. The sense of clarity and purity conveyed by vision, allows it to be explicitly associated with truth and knowledge. The law has always relied on vision and representation, from eye-witnesses to photography, to imagery and emblems. The law and its normative gaze can be understood as that which decrees what is permitted to be and become visible and what is not. Indeed, even if law’s perspectival view is bound to be betrayed by the realities of perception, it is nonetheless productive of real effects on the world. This first title in the interdisciplinary series ‘Law and the Senses’ asks how we can develop new theoretical approaches to law and seeing that go beyond a simple critique of the legal pretension to truth. This volume aims to understand how law might see and unsee, and how in its turn is seen and unseen. It explores devices and practices of visibility, the evolution of iconology and iconography, and the relation between the gaze of the law and the blindness of justice. Abstract

Professional Emotions in Court examines the paramount role of emotions in the legal professions and in the functioning of the democratic judicial system. Based on extensive interview and observation data in Sweden, the authors highlight the silenced background emotions and the tacitly habituated emotion management in the daily work at courts and prosecution offices. Following participants ‘backstage’ – whether at the office or at lunch – in order to observe preparations for and reflections on the performance in court itself, this book sheds light on the emotionality of courtroom interactions, such as professional collaboration, negotiations, and challenges, with the analysis of micro-interactions being situated in the broader structural regime of the legal system – the emotive-cognitive judicial frame – throughout. A demonstration of the false dichotomy between emotion and reason that lies behind the assumption of a judicial system that operates rationally and without emotion, Professional Emotions in Court reveals how this assumption shapes professionals’ perceptions and performance of their work, but hampers emotional reflexivity, and questions whether the judicial system might gain in legitimacy if the role of emotional processes were recognized and reflected upon.

Abstract

Fundamental rights for all people with disabilities, education and employment are key for the inclusion of people with autism. They play as facilitators for the social inclusion of persons with autism and as multipliers for their enjoyment of other fundamental rights. After outlining the international and European dimensions of the legal protection of the rights to education and employment of people with autism, the book provides an in-depth analysis of domestic legislative, judicial and administrative practice of the EU Member States in these fields. Each chapter identifies the good practices on inclusive education and employment of people with autism consistent with principles and obligations enshrined in the UN Convention on the Rights of Persons with Disabilities (Articles 24 and 27). The book contains the scientific results of the European Project “Promoting equal rights of people with autism in the field of employment and education” aimed at supporting the implementation of the UN Convention in the fields of inclusive education and employment.

Abstract

Bayes Factors for Forensic Decision Analyses with R provides a self-contained introduction to computational Bayesian statistics using R. With its primary focus on Bayes factors supported by data sets, this book features an operational perspective, practical relevance, and applicability—keeping theoretical and philosophical justifications limited. It offers a balanced approach to three naturally interrelated topics: Probabilistic Inference - Relies on the core concept of Bayesian inferential statistics, to help practicing forensic scientists in the logical and balanced evaluation of the weight of evidence. Decision Making - Features how Bayes factors are interpreted in practical applications to help address questions of decision analysis involving the use of forensic science in the law. Operational Relevance - Combines inference and decision, backed up with practical examples and complete sample code in R, including sensitivity analyses and discussion on how to interpret results in context. Over the past decades, probabilistic methods have established a firm position as a reference approach for the management of uncertainty in virtually all areas of science, including forensic science, with Bayes' theorem providing the fundamental logical tenet for assessing how new information—scientific evidence—ought to be weighed. Central to this approach is the Bayes factor, which clarifies the evidential meaning of new information, by providing a measure of the change in the odds in favor of a proposition of interest, when going from the prior to the posterior distribution. Bayes factors should guide the scientist's thinking about the value of scientific evidence and form the basis of logical and balanced reporting practices, thus representing essential foundations for rational decision making under uncertainty. This book would be relevant to students, practitioners, and applied statisticians interested in inference and decision analyses in the critical field of forensic science. It could be used to support practical courses on Bayesian statistics and decision theory at both undergraduate and graduate levels, and will be of equal interest to forensic scientists and practitioners of Bayesian statistics for driving their evaluations and the use of R for their purposes.
