This book is an ethnography of the encounter between women's words and the demands of the law in the context of adjudications on intimate partner violence. A study of institutional devices, it focuses on women's practices of resistance and the elicitation of intelligible subjectivities. Using Italy as an illustrative case, Alessandra Gribaldo explores the problematic encounter between the need to speak, the entanglement of violence and intimacy, and the way the law approaches domestic violence. On this basis, she advances theoretical reflections on questions of evidence, persuasion, and testimony, and their implications for ethnographic theory. Gribaldo analyzes dynamics that create the victim-subject, shedding light on how the Italian legal system reproduces broader conditions of violence against women. This book will be of great interest to all social scientists concerned with gender and the law.

Al estudiar la regla o cláusula de exclusión probatoria dentro del ordenamiento interno colombiano, se entiende que la regla general es la prohibición de aducir elementos de prueba que sean resultado de injerencias arbitrarias en la intimidad de las personas; por excepción, estas solamente se pueden practicar después de orden judicial, so pena de que los resultados sean excluidos del proceso. Sin embargo, en la práctica hay casos que presentan un desarrollo diferente a lo que han venido planteando la legislación y la jurisprudencia nacional, y ello se ilustrará a través de tres casos de referencia. En contraste, la regla de exclusión ha tenido un tratamiento diferente a la luz del derecho internacional, principalmente en el derecho internacional humanitario, derecho internacional de los derechos humanos y el derecho internacional penal. Siendo así, el planteamiento y principal objeto de esta obra se enfoca en la siguiente interrogación: ¿cuáles son las diferencias entre el derecho nacional y el derecho internacional sobre la regla de exclusión? La búsqueda de la respuesta impone revisar la consistencia de la posición de la Corte Constitucional cuando afirma que la regla que contiene el Estatuto de Roma es equiparable a la regla de exclusión nacional, según la Sentencia C-578 de 2002.

This book provides an in-depth examination of current, high-profile debates about the use of sexual history evidence in rape trials and its impact on jurors. In doing so, it presents findings of the first mock jury dataset in England and Wales to explore how jurors interpret, discuss, and rely upon such evidence within their deliberations. Drawing on both qualitative and quantitative insights from the 18 mock jury panels, the book highlights the complex, nuanced and intersectional impact of sexual history evidence within the deliberative ideal. Indeed, findings exemplified routine and ongoing prejudicial framings of sexual history amongst jurors, and frequent endorsement of rape myths that served to mistakenly infer relevance and undermine the perceived credibility of the complainant. The findings discussed within this book are therefore key to addressing the current knowledge gap around the impact of sexual history evidence and are embedded within broader discussions about evidential legitimacy in rape trials. The book draws on good practice observed in other jurisdictions to makes numerous recommendations for change. Aiming to inform academic, policy, and legislative discussions in this area, Sexual History Evidence in Rape Trials will be of great interest to students and scholars of Criminal Law and Criminology, as well as policy makers and legal practitioners. Este libro es el resultado de las investigaciones realizadas, durante 2018, por la Red de Investigadores del Centro de Investigación en Política Criminal de la Universidad Externado de Colombia, y presentadas en el Congreso Internacional "Presunción de inocencia, libertad y abolicionismo", en el cual se discutieron los efectos y riesgos que tiene el punitivismo en el ejercicio de la presunción de inocencia. Esta publicación pretende generar reflexiones a partir del estudio de casos sobre distintas situaciones que se presentan en el interior de las cárceles colombianas y que atentan contra la dignidad de la población privada de la libertad, en especial la población más vulnerable: los adultos mayores, las mujeres y los indígenas, etcétera. En este sentido, es un llamado a los distintos actores –entre otros, las autoridades del sistema de política criminal, la academia, los miembros de la sociedad civil y los medios de comunicación– para que de manera introspectiva y crítica examinemos la presunción de inocencia no como un principio estático sino como un principio vivo que se manifiesta en las diferentes etapas de la política criminal y cuya mala aplicación está teniendo graves consecuencias en la dignidad de la población privada de la libertad.
