The architect and researcher Elie al-Ashkar sheds new light on the transformations experienced Beirut from mid XXth century to the 1990s.His work is interested in the relationship between the Beirut landscape and urban regulation, of which he details the strengths and weaknesses. Sous l’effet des mouvements d’internationalisation et de constitutionnalisation, les droits de l’homme imposent progressivement de nouvelles limites au système pénal. Sous prétexte de punir le crime, l’État ne peut pas tout faire et les lois n’ont pas tous les droits. En contrepartie, les droits de l’homme renforcent la légitimité du droit de punir. Dans cette perspective, le présent essai apporte les éclairages nécessaires sur les considérations objectives et sur les raisons contextuelles qui commandent la transformation inéluctable du système pénal marocain. Il constitue une contribution riche et profonde aux débats en cours, au Maroc et ailleurs, sur les problèmes contemporains de politique criminelle et sur les défis que la réforme pénale doit relever.
